THE 4TH AMENDMENT

"The right of the people to be secure in their person, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

THE 5TH AMENDMENT

"No person shall be... compelled in any criminal case to be witness against himself, nor be deprived of life, liberty, or property, without due process of law."

OTHER WAYS TO PROTECT YOURSELF FROM THE LAW

1. DON'T LEAVE CONTRABAND IN PLAIN VIEW

Although we have the 4th amendment on our side, there is a "plain view" clause, that basically states if a cop can see contraband, he can do a search. So don't leave bongs, papers, roaches, etc. out in plain view. Don't smoke weed in public either.

2. NEVER CONSENT TO A SEARCH

You do not have to consent to a search at any time without a search warrant. Do not let the police talk you into letting them search your house. Things may get confusing, so it is best not to talk at all, which you will read about in the next paragraph.

3. DON'T ANSWER ANY QUESTIONS WITHOUT A LAWYER

You are not required to answer any questions with out your attorney present, and you shouldn't. Never answer any questions or consent to anything without your lawyer. I speak from personal experience when I tell you that police will be very manipulative and may even be friendly with you in order to get you to release information about yourself. In a situation such as above, just reply "I am exercising my right not to speak without the presence of my attorney." Repeat this as necessary, and do not answer any questions regardless of how innocent they may seem.

4. DETERMINE IF YOU CAN LEAVE

Police are not allowed to hold you without arresting you. They may temporarily detain you if they have suspicion, but unless they arrest you, then you are free to go. You should say, "Am I under arrest? Then I wish to leave (or to be left alone.)"

5. DON'T BE HOSTILE OR RESISTANT

Never be hostile or resistant when stopped by a police officer. Be a compliant as possible since being hostile and resistant is a charge by itself and will give the police a reason to hold you. If you are compliant and calm, then it is much easier to exercise your rights.

6. INFORMING

A big NO-NO in the world of weed is informing. You should not tell the police anything that is not your business anyway, but more often than not when you are offered a deal to "tattle" on someone else, you will end up being busted yourself. Remember that if the cops have something against you, they are more likely to use you than to help you. Plus, if you turn to informing, don't expect anyone to talk to you again.
