Dear Mary Rose,

 

Thank you for attending the neighbor community meeting last month. I believe that I sent you the list of attendees.

 

Over the last few weeks I have sent letters to the City and Franciscans expressing my concern that San Roque School will hinder the open access that has been enjoyed by the neighborhood.

 

As I have looked into the access issues, I have consulted with a few attorneys and law students. There is strong evidence that an implied dedication of the open lands at the seminary for public use ripened many years ago. I was not concerned about access issues with the potential purchase by the other school or the continued ownership by the Franciscans.

 

I have enclosed a memorandum discussing the issues. Please forward to the appropriate parties.

 

The property does need structural improvements, I am glad that the Sperlings have the ability to correct the deficiencies. But, please realize that I not willing to lose access to the property.
