4 THE REVOLUTIONARY

CONSTITUTIONAL FRAMEWORK

Federated Socialist Commonwealth

Draft Constitution

Preamble:

This constitution is designed as a remedy to the situation in which the previous (military plutocratic) political & economic order will completely have rotted away/ descended into warlordist anarchy and a new revolutionary military political movement will have been required to crush the warlordists (& delegitimise/ overthrow the decayed remnanat of the old order) & forge order out of the chaos.
This constitution is concieved as the basic framework neccessary to consolidate this order, to establish a viable centre of political economic gravity in the post military plutocratic epoch.

(1) The right to keep & bear arms - This is the right which underpins all others.

(2) Workers' control of finance, land and the armed forces, through democratically elected Workers' Pension Councils.

(3) A separation of powers between economic democracy (control of production through control of finance) and political democracy (the power to re-distribute wealth) - to safeguard against the danger of an over-concentration of power. Eg:

(a) The WPCs acting as a permanent bulwark against speculation/finance being a law unto itself - so that parliament be free from the pernicious hegemony of finance. And in turn prevent:

(b) A political class, out of short termist demagogic opportunism, seeking to treat capital as income (with catastrophic pol/econ consequences). The WPCs be a check against finance hegemony, but in turn denied the opportunity to engage in such opportunism - as political power (the power to re-distribute wealth) resides with parliament.

(4) WARTIME sacrifices (especially from the richer states -eg Euro/ USA commonwealths) to finance Global reconstruction & the Green Revolution (The 100 Year Plan).

That the central power be delimited to perform only those functions allowed it by the regions/constituent republics.

That its role (there being no national security state role for the nation state to perform any more) be primarily a redistributive role - especially to aid development/reconstruction - to insure stability between the constituent parts of the federation. Preventing richer components choking on their own barbed wire through militarised expenditure in an effort to keep down the poorer (note the $19 TRILLION squandered by the USA govt on `defense' between 1940-98). Or else, the richer states shall be subject to massive migration, and in an attempt to keep down the poorer, retain by default or re-introduce a plundering military- plutocratic national security state/pol/econ regime; and continue to choke on their own barbed wire.

That this principle be extended to include all free nations in a global commonwealth confederation (as a 1st step towards an eventual global commonwealth federation). It is not possible to (fully) scrap immingration controls until:

(A) The 3rd world is raised up (establishing relative global economic economic equilibrium), so to prevent the Euro/ USA choking on their own barbed wire WARTIME sacrifices to finance global reconstruction/ (from the richer to the poorer) confederated commonwealths must be made.

(B) Population growth in the Indian & Chinese megastates has been stabilised, so that population transfer (to the park states Canada, Russia & Africa) can take place (to further take the pressure of these states) without transfering catastrophically high birth rates.

Furthermore, to this end, western Europe (defined for global, especially Russian reconstruction), must martial an alliance (an emerging megastate) of Europe, Russia & USA around the banner of the Green Revolution, to aid (via massive TOTAL WARTIME scale investment in zero & positive impact energy technology - especially solar powered desalination - to make the deserts cultivatable & turn farmland over to woodland; & above all defuse the oceanic methane timebomb that threatens a warming that would devastate the rainforests/ carbon sinks, melt the polar caps, overwhelm the warmwater currents triggering a new iceage) the Chinese & Indian megastates development (raising living standards/ education is the most effective form of contraception/ population stabilisation), with the active support of Chinese & Indian civil society (without whose active support/ participation, the world would sink into chaos & warlordism) for such a green revolution global reconstructionist/ global immigration policy.

If the transAtlantic megastate renaged on its historic mission... then in its attempts to keep the old 3rd world down, it would choke to death on its own barbed wire, & fragment itself (as megastates cannot survive as imperial powers because their size means that they would be seen as the the main threat to their own people - this tendancy to fragmentation & clampdown on the common ownership of info is the built in alarm system to forewarn the armed citizenry of their duty to crush such warlordist tendancies & stomach the bitter WARTIME sacrifices required to finance global reconstruction).

In the modern world states cannot any longer survive as mere geographic entities bonded by a common hatred of neighbours, they must be held together by the culture of the common threat & objective that confronts humanity as a whole & their specific role within this new global culture. States (including the TransAtlantic megastate) must arise, evolve & be eclipsed in accordance with the requirements of objectives/ threats that confront humanity as a whole.

The Green Revolution represents revolutionary civil society's first great objective as a conscious hegemonic force, as master of its own destiny with finance as its servant not its overlord.

(5) That there shall not be a secret/political police.

This means complete freedom of all government information. No stockpiling of secret information unaccountable to the public by any military or any government department. Otherwise a secret police shall emerge by default, stealth and pathologically appropriate to itself, unaccountable power.

ALL police (and military) power must be rooted in 2 distinct but intrinsically linked currents:

(a) Civil mobilisation against power crime. Eg the determining by finance hegemony (being a law unto itself) of the pol/econ agenda for its own core elite interests to the detriment of the general social/pol/econ. And govts, governmental structures which do prostrate their laws/structures before said hegemony of finance, so aiding and abetting the interests of a core elite at the expense of the general social pol/econ .

This includes the curtailment of civil rights consolidating a criminal regime/agenda. And further includes all activities (eg ultra orangeist sectarian marches Paisley et al & similar from overt fascists eg BNP/Zhirinovsky/Le Pen etc) designed to deny any section of the citizenry (eg the Nationalist community of N. Ireland - within the British/ ultimately dissolved into European federation) their constitutional rights as free and equal citizens under the constitution.

(please note - as the current law be determined be a criminal agenda, the constitution to be enforced retrospectively - we cannot judge the criminals by their own financier determined corrupt legislation). And:

(b) Community mobilisation against petit warlordism/ordinary crime (anchored in the anti power crime dynamic - to prevent a slippage into gangsterdom that arises whenever vigilantism has NO stable social pol/econ framework to operate in). Police and military power to be rooted/derived wholly from the ACTIVE community/civil society and NOT (as at present) a law unto itself.

(6) The common ownership of ALL information. The only way to eliminate the political police is to eliminate the private ownership/control of information; for the protection of this process of information control necessitates a (hierarchical society and) secret/political police to protect it.

(7) WPC control of the collegiate presidency & constitutional court. To further entrench socialist hegemony and prevent parliament changing/amending the constitution. This is the sole prerogative of the WPCs.

(8) That in a national/transnational emergency, the WPC controlled Citizens' Guard re-assumes police/marshall powers, to safeguard against the threat of a parliamentary or military coup.

(9) That attempts to impinge on WPC economic democracy/control of finance be constituted a treasonous violation of the constitution/economic democracy and invite a new insurrection.

Vis Article 5, Secrecy is vastly more trouble than it is worth, having the effect of disarming civil society against especially power crime.

Yet it will be easier for civil society to prevent the media intruding on ordinary citizens private lives through popular pressure on advertisers/finance (including through the WPCs) - with the setting up/evolutionary development of a voluntary code of conduct, yet with teeth, to lean on the press not to market such crap (on pain of being starved of advertising revenue).

The prurient scapegoating of false enemies (eg single mothers etc) can and should be curbed by civil society - just as (Chomsky notes) money (as opposed to civil) society does to the resistance/socialist ideas.

As article 6 of the Draft Constitution means the wholesale tearing up of copyright law, we need to outline how capital flows into Research and Development, if not principally through private corporations.

Capital flows into RnD through a process of layered development.

Educational establishments (including inventors, theoreticians etc),

produce new ideas/prototypes etc

Firms engaged in end user production (whose profits be taxed)

draw from the RnD of 1)

(WPC/Parliament) insures the recycling of profits to the beginning

Furthermore Workers' Pension Councils to have a say in the running of educational establishments (eg direct general business/end user input); with a much greater role for educational establishments than at present vis RnD. But if deemed to interfere too much, the citizenry have recourse through elections to WPCs to change policy/personnel.

This process leads to a total melding of education with the corporate world under the hegemony of civil society. Determining an evolving much greater importance of the social wage including education/access to information (with a duality/merging of increasing productive potential with leisure), and withering away of the significance of the private wage.

The Democratic Dictatorship

Democratic Dictatorship refers to the means by which finance capital is to be systematically disarmed as a ruling class, laying the foundation for revolutionary democracy.

In the provisional govt, it pertains to the bringing to trial & execution of the crooks and the drawing up & ratification of the new constitutional division of power by the WPCs, after which fresh elections to national/regional parliaments take place (ending the temporary political democratic dictatorship of the WPCs).

But during the struggle to seize power, it refers to the temporary martialing of the masses under the military command (military Revolutionary Council) of the WPC executive - exercising for the duration of the uprising, full executive authority - to give a clear co-ordinating head to the revolution. After the enemy has been vanquished, power cedes to the WPCs - pending fresh elections to be held after the crooks have been tried & executed and the ratification of the new constitution.

Should the Wpcs or Military Revolutionary Council attempt to outstay their political welcome, they shall incur the wrath of the mobilised masses.

Democratic Dictatorship also refers to the premanent control over finance by the WPCs - A dictatorship over finance, democratically controlled by and for the benefit of, civil society.

This is quite distinct from the Marxian notion of `Dictatorship of the Proletairiat' in which the over concentration of both political and economic power (the practically inevitable product of the unique historical conditions of Russia 1917 - which we shall examine later in chapters 5 & 6 of S.O.F. Vol 1 - the lack of clear econ priorities leading to consequant panic), in the soviet (led by a single party), leads inevitably to a one party state.

The Seperation of Powers (Framework as opposed to Party)

Finance must not be allowed to be a law unto itself, therefore it is imperative that the basic econ agenda for finance is controlled by the WPCs (essential as a permanent bulwark against speculation - insuring finance serves industry and labor instead of the reverse) - with the absolute minimum of bureaucratic interference.

Eg we do not want some half - arsed commissar appointed by edict, as head of a biotech corp, just because he/she once led a mass demo or tongued the right bureaucratic ringpiece.

For this reason (also) we want seperation of powers between economic democracy & political democracy. Or else every econ & political question becomes a threat to the rev power & constitution.

This means the only way of propping up such an inflexible system is a nat sec state leading to outright Stalinist dictatorship - which will set its own rationing agenda (to secure/reconsolidate its' power - which we shall examine in chapter 6 S.O.F. Vol 1) and doom any fraction pushing for reconstruction of the capital base on the basis of autonomy and control from below (as ironically was to be Lenin and Trotsky's fate).

Fortunately this is no longer historically possible (we will examinein Chapter 6 the unique conditions in 1917 Russia which led to this/made this possible), and the populace will (rightly) not tolerate a WPC political administration that outstays its welcome (after criminals strung up/constitution drawn up and ratified) and seeks to extend its hold on power by resorting to such measures.

As NOT party, `leader' - centred (but rather framework/activist centred), the movement (rev govt) is collegiate in construct (reflective and inclusive of a wide variety of pol/econ currents with different emphasis within the general reconstructionist framework) - with a shifting centre of gravity in pol/econ orientation (related to temporary weight/significance).

Initially (as needs must) centred on fiscal parsimony to finance the repairing of the damage to industrial capital base. Becoming more and more geared to social wages (note the duel role of vis living standards and increasing productivity in the knowledge society). And manifesting itself in a permanent devolution of pol/econ power to smaller pol/econ units and to the individual.

The unwritten component of the rev constitution

Governing the whole constitutional framework is an unwritten component to the constitution, the moral dictatorship of the martyrs (immortality of the idea), the mechanism by which the citizenry keep their leaders in check, with the threat of a new revolution should any attempt to violate the constitution.

To preserve disc space I have not replicated here relevant info in:

a)Chapter 2 Vol I on checks/ balances at the beginning/ end of the rev process (especially vis `splitting the idea from the personality that uncovered it') and:

b) Vol II, vis further analysis of Qs surrounding the immortality of the idea/ God dialectic/ moral dictatorship of martyrs (that can best be understood by frstly reading part II of Vol I which covers the evolution of the industrial global pol/econ from Chartism onwards and the failure of classical laborism/ Marxism - including a groundbreaking re-interpretation of the reasons for the failure of the Russian Revolution in Russia & geo strategically).

Please refer to as neccessary.

Law & Order & the Revolutionary Constitutional Framework

While the Revolution will crush those that threaten its security it has no interest in revenge for its own sake, as this undermines the interests of the Revolution (through avoidable additional fear vastly exacerbated by the fear of a political force that places a greater priority on revenge than reconstruction & using the talents of old enemies for the purpose of reconstruction)...

Therefore beyond what is neccessary to show that it is determined to forge order, the Revolution is more geared to clemency than revenge, to make the (productive) most out of hostile elements of the old order....

....Correspondingly, if the Revolution can, must show such restraint in dealing with power criminals (the most dangerous class of criminals) it cannot deal differently with other (lesser) catagories of criminal.... if it were to, this would descend into base Caesarist populism, pandering to the unthinking desire for revenge in order to act as a cover for greater (resurgent) military plutocratic elite crime.....

The only true security is in forging a common pol/econ culture united by the common threats/ objectives that confront all humanity, or else humanity's own knowledge/ power to create shall merely forge the instruments of its own utter destruction....

With this in mind, the legal centre of gravity must be towards security & restorative justice (upholding the authority of the law of the community) with no concession towards revenge at all....

The death penalty has its place, but only when the security of the rev state is under attack by a (power) criminal agency.

Towards this end a permanently ongoing dialogue should be fostered between elements of the old criminal ruling order, civil society & criminal elements themselves, as to how civil society's security can best be met practically.

The proximity of old ruling lags with rev civil society (both of which should be wary of a revanchsit approach) should help develop innovative ways of countering the criminal mentality, which hitherto has sought a twisted sense of pride in `us against them' if only to survive in a world governed by literally murderous hypocrisy of the ruling elite & the murderous complacency of those that (currently) tolerate their imperium, that care nothing, consider nothing about the consequances of their moral complicity (certainly not sufficoent to consider the price of what it will take to prevent the slide into anarchy) and yet haughtily imagine themselves morally so very far apart from the criminal orders per se...

.....failing to see that all criminality has its root in the common crime of failing to consider the reality that the only way humanity can survive is by confronting common threats/ objectives that face it as a whole & what this will cost in blood & treasure.....

It may be though that the pathology of certain delimited types of criminal (eg paedophiles) is so deeply ingrained within every level of their persona, that they are like high level radioactive waste - best kept safe in glass blocks for security's sake until such time as an innovative way be found to deal with such....

In reference to Article 5a:

Is there not the most fundamental contradiction between the rights of all peoples as free & equal citizens under the constitution' & free speech after military plutocracy eclipsed? & if so, HOW to resolve (after all we cannot have massive KGB style surveillance by a nat sec state, this would sound the death of the Revolution)?

ALL power must rest with the conscious people, cogniscent of the need for WARTIME sacrifices for global reconstruction.

Put bluntly, until they recognise the imperative of such for geo pol/econ stability (their own survival) bloodshed will manifest itself UNTIL this issue is settled for global reconstruction, enabling stability.

Moreover this is how/ where conscious civil society/ knowledge society FIRST learns to govern itself, treating ideas with deadly respect & caution. Where it learns that ideas should not be treated loosely, any more than weapons grade plutonium should be, for the consequances threaten oblivion.

A people desperately craving order, having experianced military plutocratic anarchy & being educated by the political army (so that they are able to learn from bitter experiance instead of retreat into the laager), will learn the hard way, the only way, that only through WARTIME sacrifices in treasure (for global reconstruction) as well as blood, can the order they will crave be gaurenteed.
