Mercy Salsbury sometime the widow & Relict of Richard Heath of Swanzey in the County of Bristol Deceased now the wife of Cornelius Salsbury of Sd Swanzey, Approvd this sixth of August 1707 Before the Honable Nathal Byfiled Esqe Judge of Probate of wills & within the County aforesd. And made Oath tha the Inventory on the other side written is all that was left of her former husband's estate the time when she Intermarried with her present husband & that she had not wasted the said estate but with her own Industry had payd. Many of the Debts left by her former husband and when she knows more she will reveal it that may be herewith entered and Recorded

Settlement of the Estate of Richard Heath
November 6, 1707

To all People to whom these presents shall come Greeting &c ----
Know yee that whereas Richard Heath formerly of the town of Swanzey in the County of Bristol in New England Taylor yeo. leaving a small estate valued at forty four pounds one shilling & seven penies as by the Inventory thereof upon Record may appear of which there hath been no Division or settlement as the law directs, And the eldest son of the said deceased namely John Heath having receipted of four pounds in full of his part, and in consideration of the sd sum of four pounds payd fully and every part thereof by his father in Law Cornelius Salisbury of Swanzey aforesd. Hath sold his part in said estate to his sd father and by a Deed of the same duely executed under the hand and seal of the said John Heath -- bearing date December the fourteenth 1705 may more at large appear who is now *beyound sea and is not Returned nor is it known when he will.

The premises considered, the parties Concerned being legally capable to Act for them so selves Do mutually agree & conclude of a settlement of sd. Estate in manner & form following that is to say --

That the above Named Cornelius Salisbury Together with his wife Mercy Salisbury late widow of the sd Decd Richard Heath inconsideration of her great love and Industry in bring up her children being very young when their father Richard Heath Deceased shall have Possess and enjoy the whole of that estate which is left Alwayes provided the said Cornellius Salisbury shall & do and the perfecting of these presents become bound by and obligatory for the payment of twelve pounds within one year of the date of these presents unto Joseph Heath & Hannah Heath or either of them their heires or assigns as their part and portion in said final effect And in Testimony that this is Our Mutuall agreement - Refering to the settlement of sd estate to our full Satisfaction we the said Cornelius Salisbury & mercy his wife John Heath & Hannah Heath have sett to our hands and seals this sixth day of November in the year of our Lord one Thousand seven Hundred & seven in the sixth year of her Majties Reign -----------------------------------------------

The persons within named to wit Cornelius Salisbury with his wife Mercy Joseph Heath & Hannah Heath all of Swanzey in the County of Bristol on the tenth day of November 1707 Appeared before Nathal Byfield Esq. Judge of Probate of wills &c within the County of Bristol aforesaid and do- each for themselves acknowledge consent & satisfaction in the Instrument of settlement of the estate of the within named Richard Heath Deceased and that the same is the Voluntary Act and Deed: which by the sd judge (being perused) is accepted and allowed as a settlement of said estate & ordered to be of Record.
