     JOHN FINNELL who appears in the early records of Culpeper and
Rappahannock Counties, Virginia was the son of Reuben Finnell (1750-1823)
and his first wife, Henrietta1 (1756-c1788/89).
     For several years we have collected and filed away bits of information
regarding John Finnell. After Merlin and I visited Rappahannock County
Clerk's Office in August 1976, and read the old records about him, John
Finnell began to emerge as a real person. Perhaps the atmosphere of
Washington, a county seat populated by 18922 persons and
much unchanges since the county began in 1833, helped put flesh on the
bones of John Finnell. After we searched the old records his hopes,
dreams, ambitions and many disappointments came alive.
     From the records that we have to date (July 1977) I will attempt to
tell in the order that they occurred the story of the life of John Finnell.
Based on actual court records the facts are as true as such records can
prove. A few items that are assumptions or appear to be true will be duly
noted.
     JOHN FINNELL was born 10 Mar 1779 in Culpeper County,
Virginia where his parents resided at that time. He was the second child and
second son of the family of Reuben Finnell and Henrietta, his wife. Robert
born in 1777 was the older brother of John. Fanny (later Menefee) born c1785,
Alexander [Sandy] born c1786 and Sarah [Sally] (later Murphy) born 1788
complete that first family as we know them to date. If there were more
children we have no proof.
     The exact date of the marriage of John Finnell to Elizabeth Burch
Thorn3 remains as enigma at this time as I have three differing
dates from three different sources. In the Fauquier County Court House at
Warrentown, Virginia is the record of the marriage between John Finnell and
Elizabeth Burch Thorn4, daughter of Peregrine Thorn. A xerox
copy of the old document reads as follows:
     "Know all men by those present that we John Finnell and
     Alexander Finnell are held and firmly bound unto John
     Page Governor of Virginia, in the just and full sum of one hundred
     and fifty dollars, to which payment well and truly be made, to the said
     Governor or his successors, we bind ourselves, our and each of our
     heirs, executors and administrators, jointly and sverally, firmly
     by these presents.
     Sealed with our seals, and dated this 18th day of
     January 1804.
     The conditions of the above obligation is such, that whereas there is a
     Marriage shortly intended to be solemnized between John Finnell
     and Elizabeth Burch Thorn now if there be no lawful cause to
     object the said Marriage, then the above Obligation to be void,
     otherwise to remain in full force and virtue."

This is typical of the marriage license form for the State of Virginia at
this time. They were married by the father of the groom, Rev Reuben
Finnell, a Methodist minister at the father's home in Cupleper County.
John was 25 years old and Elizabeth B. was 19. This began a marriage that
would span 58 years together and the rearing of a large family by the
couple in Rappahannoch County near Flint Hill.
     Years later on the application for a widow's pension for John's service
in the War of 1812, Elizabeth states that their marriage had taken place
on 19 Jan 1804 which is one year before the Fauquier County record.
Undoubtedly the burden of her 88 years may have dulled her memory for
dates. Or, was there a possibility she had wanted her family to think
they had ben married a year sooner?
     On 23 July 1977 I received a letter from Lillie N. Finnell of
Rileyville, VA listing the marriage date for John and Elizabeth B.
Finnell as 22 January 1804. This record appears to have been taken
from a Bible Record sometime in the past. Lillie is the widow of Keyser
Finnell, son of Vincent Finnell, grandson of John A. Finnell, Jr and
great grandson of John Finnell and Elizabeth Burch Thorn Finnell. I am
grateful for the birth dates of the children and for the obituaries
of John and Elizabeth B. Finnell that Lillie Finnell sent to me.
     John Finnell served in the War of 1812. A study of the servce records
and pension files in the National Archives reveals that the two full
brothers, John and Robert Finnell, and one half brother, Charles W.
Finnell, all served in Capt Charles Shackelford's Company of the
Virginia Militia. They joined on 11 Aug 1814 in Culpeper County and
served until they were discharged on 17 Dec 1814 at Fredericksburg.
Robert's service record states that he was paid $33.78 for the time
spant on the tour of Duty. He was also paid 77cents allowance for
traveling the 60 miles from Frederisksburg to home and 51 cents
subsistance while enroute home. Since John and Charles W. served
with the same militia for the same length of time and they lived
near each other in Culpeper County the same pay scale would also have
applied to them.
     John had children prior to his entrance into the War. One place in the
pension application says he had three living children at the time and
another says he had several children when he entered into the service.
The birth records sent by Lillie Finnell list these children as:
Thomas T. Finnell, born on Sunday 4 Apr 1805, John A. Finnell born
on Saturday, Aug 29, 1807, Justinian Finnell born on Monday 28 May 1810,
and Nancy B. Finnell born on Monday 1 Mar 1813.
     In August 1975 when Merlin and I copied and abstracted from the
Granter & Grantee Indexes for the Deed Books in Culpeper County there were
many entries for John and Elizabeth Finnell. At the time that we copied
them I thought they were all telling of land transactions made by
John and Elizabeth Burch Thorn Finnell. This past winter through
census research I have found there were two different Finnells
living in Culpeper County, married to two different Elizabeth Finnells
and of the same generation. My reference for this is Roll 324 of the
Culpeper County 1850 census taken on 30 July of that year.

     The presence of two John Finnells living in Culpeper County, Virginia
complicates the interpretation of many of the early records. John Finnell
born c1778 and John Finnell born 10 Mar 1779, son of Reuben, were
possibly first cousins. John, the younger, married (19/22 Jan 1904-18 Jan
1805) Elizabeth Burch Thorn and later resided in Rappahannock County.
Henceforth, I will refer to him as John of Rapahannock County.
     John, the elder, also married a women with the given name of Elizabeth.
At this time I do not know her surname, but there was a marriage license
issued on 11 Jan 1798 to John Finnell and Elizabeth Chambers in Orange
County. John, the elder of Culpeper County, would have been about 20 years
old at this time so this may have been his marriage license. Bondsman
for The John Finnell - Elizabeth Chambers marriage was James Finnell.
This does not prove, however that James was the father of John. Often
a brother, cousin or uncle would serve as bondsman.
     On 2 Feb 1797 a John Finnell married Caty Surry in Orange County
and James Finnell was also bondsman. There is proof that this John and wife
moved to Clark County, KY so that that removes him from complicating our
Culpeper County records.
     At the time of the American Revolution there were several adult
members of the Finnell family living in Culpeper County. in addition to
Reuben Finnell, Benjamin, Elijah and John Finnell had households of their
own. Benjamin and his wife, Sarah Carter Sleet Finnell left Culpeper County
and migrated to Scott County, KY about 1797. Elijah died in Culpeper County
about 1786 and in his will left all of his estate to his wife, Frances
Finnell. He names no children in the will although they may have existed.
John,6 the brother to Reuben served in the Revolutionary War
and lived in Culpeper County after the War. It would seem logical that John,
the elder, was a son of this John, Minute man and brother to Reuben and son
of Thomas.
     In Culpeper County Deed Book KK, page 368 is recorded the record of
land purchased by John Finnell from Frances [Fanny] Gore. The deed was
dated 7 Oct 1818 and recorded 17 May 1819. At this time I believed this must
have been the purchase of John Finnell, the elder of Culpeper County, as the
lad was located on the west side of the road leading from Raccoon Ford to
Stevensburg. This would have placed John near the area where he lived in
later years as verified by the deed records which say the land was
not far from Rocky Branch. Rocky Branch is a stream that starts south
of Stevensburg and eventually empties into the Rapidan River.
     John Finnell of Rappahannock County appears among the list of buyers
at the public auction of the estate of Henrietta Compton7 in
Culpeper County on 20 May 1822. John spent $18.00 that day when be bought
a no horned steer for $11.00. a small bull for $4.42 and a yearling for $2.58.
Reuben8, Robert9, and Thomas10, also made
purchases at the same sale.
     The first purchase of land by John Finnell of Rappahannock County was
from the Clement Hasty heirs and is found in Culpeper Deed Book YY, page
319. The date of the deed was 10 Nov 1827, but was not recorded until 2 Mar
1832. The land began at Col. William  Beverley's corner on a branch of
Hedgman's Run. The deed was witnessed by Joshua Gore, Thomas J. Finnell
and John A. Finnell. Although John Finnell was well established in
farming by this time this is the earlest record we found of land
purchased by him. It is to be assumed that he must have rented land
prior to this time.
     By deed dated 13 Jun 1828 and recorded 17 Feb 1830 in Culpeper Deed
Book WW, page 268, John Finnell made an additional purchase of 100 acres of
land for $164. This transaction was "under a Trust Deed executed by Edmund
Lee and wife Sally of Alexandria, District of Columbia to Robert Taylor,
conveyed to the said Lee by Levi Duffy, who purchased of Peter Holly, who
purchased of Joseph Gilbert and Nancy, his wife, which Nancy before her
marriage was named Nancy Cheek, and was the original patentee, and to whom
was granted a patent on the 26th day of August 1778.
     The 100 acres began at two chestnut trees on the North side of an arm
of the Blue Ridge and ran thence N 32 E one hundred poles to a large chesnut
oak and a chesnut oak sapling on the north side of a track leading to
Gooney's Run; thence S 58o E 160 poles to two chesnut oak
saplings and two large Chesnut oaks on the south side of the North
prong of the Indian River thence s 32 W 101 poles to a chesnut tree
and two chesnut oaks on a Ivy Hill and then N 58o  W 160 Poles
to the beginning". It borders land owned by Bazel Gordon11.
This is situated in what is present day Wakefield District in the
extreme northern part of Rappahannock County.
     John Finnell owned this 100 acre tract for nine years. In 1837 the
Commissioners of the County of Rappahannock met at the May Term of Court
to "select a suitable site on which to erect a Poor house and work house
for the reception of the Poor and the reformation of Vagrants." After
examining three prospective sites, "the third farm, then owned by John
Finnell, containing about 100 acres has been after due deliberation
selected it being sufficiently convenient to any part of the county,
and possessing the great advantage of abundance of timber and wood,
and the water being convenient to the proposed site of the Poor house."
John and Elizabeth B. Finnell were paid $600 for the site.
     In the 1860 census John Finnell, by now 81 years of age (census age
given as 80 yrs) and Elizabeth, now 76 years of age (census age given as 74
yrs), lived two doors from "The County Poor Settlement" near Flint Hill.
     This old Poor Farm passed from the scene many years ago and few
persons residing in Rappahannock County today have any knowledge that such
an institution ever existed in Wakefield District.
     On 16 Sep ,1873, thirty-six years after it began, the supervisors
of the County of Rappahannock desided to sell the property known as the
"Old Poor House Property". It was purchased by Gabriel and Charles Dulin
for $400. When Charles died his share of the 100 acres was taken over
by James M. Dulin. James M. Dulin sold the land on 22 Sep 1922 and the
Deed goes into great detail telling that the 100 acres was once owned
by Bazil Gordon. No where in the 1922 transaction is it mentioned that
John and Elizabeth B. Finnell had ever owned the old poor farm property.
Time takes its toll and families are forgotten.
     A later land purchase by John Finnell is found in Culpeper County Deed
Book YY, page 324, date of Deed 7 Dec 1831 and date of record 9 Mar 1832.
He paid $200 to Robert Eastham and Frances his wife for 168 acres on a
branch of Little River. It joined his previous 100 acre purchase and was
bounded by lands of Compton, Updike and Thornton.
     In addition John Finnell had been granted a parcel of land containing
about 80 acres by the Commonwealth of Virginia. This would have been for
his service in the War of 1812 and was granted prior to 1835. The bounty
land tract adjoined the land Finnell had purchased in 1827 from the
Clement Hasty heirs. Neighbors who owned land close by were William
Bailey and John Briant.
     In 1833 Rappahannock County was formed and the court house and
county seat of government was established at Washington. Even through the
county was new, the town of Washington was not. Surveyed, platted and
established  by George Washington on 24 July 1749, it was named in his honor
by Lord Fairfax. Incorporated as a town in 1792, it had been in existance
many years when Rappahannock County was started. The new county was
taken from the northern part of Culpeper County and was named for the
river which traverses it, and which likley took its name from the
Indian tribe that had lived along its banks. Because of the seperation
from Culpeper County,all of John Finnell's land purchases are on record
in Culpeper County Deed Books and yet after 1833 all legal records about
John are filed in Rappahannock County while John during all of this time
lived in the same place on the same farm.
     In the Clerk's office at Washington, Virginia, restored and well
preserved under a plasticized finish is the original 1833 Property Book
of the County. It is a list of taxable property within the District of
Daniel Brown, Commissioner of the County and lists all white males over
16 years, slaves over 16 years, horses and mules, slaves age 12 to 16
years and the tax paid by the individual.
     On Feb 15th, John Finnell was listed with 2 white males over 16 years,
2 slaves over 16 years, 12 houses or mules and he paid a tax of $1.22.
Although this was not the highest tax lised for an individual in the
old property tax book, it did show John as being one of the larger owners
of horses and mules. This would indicate that John, now 54 years of age,
was more heavily into farming than many of the other male residents of
Rappahannock County. Of course by this time he had had adult sons to help
him. Also listed on Feb 25th was Thomas Finnell12 as 1 male
over 16 years. On Feb 24th John A. Finnell13 and Justinian
Finnell14 are recorded as males over 16 years of age. None
of the younger Finnells paid any tax as they had no slaves or horses.
     In Rappahanock County Court of June 1833 it was "Ordered that John
Finnell be appointed surveyor of the road from the mouth of Dearing's
lane to the Chester's Gap road near Clark's old place" a position
be still held in Aug of 1836. John would have been 54 years old at the
time of this appointment. February Court of 1854 records "For reasons
appearing to the court it is ordered that John Finnell surveyor of the
road from Dearing's Land to Chester's Gap be replaced by John Eastham."
It would appear from this that perhaps John had held the position for
the entire 21 years. By 1854 he would have reached 75 years of age and
was probably replaced by a younger man.
     The Deed and  Minute Books of Rappahannock County contain many
entries pertaining to John Finnell. Often the old records tell of debts
owed by Finnell, pledges for indebtedness, or of the proposed sale of
land to satisfy creditors. At one time in 1847 brother Alexander or
Warren County financially backed John.
     Today a farmer would go to the bank or some other lending institution
to arrange his finances if he needed to borrow money for his farming
operation. In the 1830's there was no business conducted through banks
this way, but rather through bonds issued by individuals of the area
usually ended up the wealthier for the venture. Such a man was Bazil
Gordon of Falmouth, Stafford County, Virginia. By a bond bearing the
due date of 28 May 1835, John and Elizabeth B. Finnell were indebted
to Gordon in the sum of $1678.19 plus interest. Because of this debt
the Finnells conveyed land in a Deed of Trust to Samuel Chancellor
(Deed Book B, pages 176-79) to be held by Chancellor until Finnell
either paid Gordon or turned the land over to him in payment. It is
from deed records such as this that we obtained vivid descriptions of
the land and possessions of John Finnell.
     In May 1835 it was arranged so tha John Finnell should pay "one fifth
of the sum of money due upon the bond aforesaid, on the 1st day of January
1837, together with the amount of interest which may have accrued upon the
whole sum; and also the other four fifth, in four equal annual payments
thereafter, together with the whole amount of interest wich may have accrued
upon the sum unpaid, at the said several days of payment specified,then this
indenture, and every thing therein contained, is to become void. But if the
aforesaid John Finnell should fail to pay the said Bazil Gordon on the
day and date last above written 1/5 of the whole of the bond aforesaid,
together with the interest which shall be accrued on the whole amount
thereof, or shall fail to pay the remaining four fifths as they shall
severally becomes due and payable together with the interest as aforesaid
or if he shall fail to pay any part of the principal or interest at the
several times at which they are hereby stipulated to be paid, then the
said Samuel Chancellor his heirs or assigns, shall and may sell, and
dispose of the aforesaid lots of land, or so much thereof (as may be
necessary to pay and satisify the aforesaid Bizal Gordon the amount
of principal and interest, which may at anytime be due and unpaid,
according to the terms and specifications above enumerated) at public
auction to the highest bidder, for ready money upon the premises, or at
the Court House of the County aforesaid". Thirty days notice of the
time and place of public auction must be given and notice posted at
the Court House door and a public place in Flint Hill and Samdy Hook.
     The land Book of Rappahannock County for the yeasr 1836-1847 list
John Finnell as owning 268 acres on the Ridge and 116 1/4 acres on Little
River. A part of this land was farm land. Much of his acreage, however was
on rugged terrain and was heavy timbered.
     Because most of this area on and near the Blue Ridge was so thickly
forested, lumber became a big business. In the autumn of 1844 John Finnell,
now 65 years old, leased a grist and sawmill for 5 years from Lawson Eastham.
(Rappahannock Deed Book F pages 186-87) He took as his partner his
youngest son, James F. Finnell. The grist and sawmill along with the
dwelling house was situated on a lot of eight acres. They agreed to pay
Eastham "yearly rent of $137.50, one half to be paid in corn, rye,
buckwheat and pork, in the proportions of each that the mill may grind
of the grains mentioned, at cash prices, (as also the pork at the cash
price of the neighborhood) and the other half in plank and other timber
as the said Eastham may furnish a bill of at the following rates, viz:
inch plank lumber 0ne dollar, inch and a quarter one dollar and a quarter
per hundred feet half inch ditto eighty cents, three quarter ditto squared
eight seven & a half, three quartered unsquared seventy five cents,
scantling and all or any other timber that may be taken by said Eastham
at such prices as may be agreed upon by the parties. The grian to be
furnished at intervals of two or three months, or oftener if the Finnell
sees proper, and the pork in the fall during the port season. The plank
at any time that it is wanting when there is a sufficiency of water to
saw, provided always and upon condition nevertheless that if it shall
happen that the said  yearly rent shall happen that the said yearly rent
shall not be paid by the 25th day of December in any year the same or so
much thereof as shall be then due shall be held to be due in money and
the said Eastham hereby binds himself to make such repairs as are or may
be absolutely necessary from the ordinary use of and wear of the
machinery, but either mill, except the furnishing a saw and pitman,
and keeping the dogs of the sawmill in order, and a mill stone in case
the old one should break, and except also repairs which may be made
necessary be neglect or want of skill in the Millers and sawyers."
     It is interesting to note that at this same time John's brother,
Alexander Finnell was also operating a factory and sawmill a few miles
north in Warren County on Happy Creek.
     It would appear that the winter in the sawmill did not bring the income
that had been expected because on the following 13 Jan 1845 (deed Book F
page 208-210) is recorded a lenghty list of creditors seeking payment from
John Finnell through their agent Gideon H. Brown. Unless paymet was soon
forthcoming Finnell would forfeit "the following tract of land lying in the
County of Rappahannock and bounded by land of Bazil Gordon, John Updike
and others containing about ten acres and known as the orchard tract and
being the same upon which Joshua Gore has resided for several years past,
with all and singular the house and all appurtenances thereto belonging
or appertaining, together with the rents, issue and profit thereof,
together with the negro slave, and Juda, and together with the following
personal property to wit: ten horses, three colts, fifteen head of
cattle, fifteen sheep, thirty hogs, 1 new wheat fan, two wagons and all
the gear being 8 set about 250 bushels wheat and 100 burrels of corn all
the farming utensils consisting of 8 ploughs, 1 harrow etc, and all the
household & kitchen furniture of every description, consisting of beds
& bedding, chairs, bureau clock etc. & also the growing crop of wheat
and rye sown upon the lands or farm of said Finnell together with the
growing crop of wheat and rye upon Gordon's manor." Finnell was given
until 1 Mar 1845 to settle the debts or the foregoing possessions
would be sold.
     Finnell evidently kept his possessions, but the records of the years
following show his debts still plagued him. When the 1860 census was taken
on 19 Jul of that year John Finnell, by them 81 years old owned no real
estate and had personal property valued at only $200. Elizabeth was now
76 years old and lived near Flint Hill. Daughters Eliza Jane and Mary
Henrietta lived with them. Three year old Ellen Finnell completed the
household.
     I had known for several years that John Finnell had received bounty
land for his enlistment and service in the War of 1812, but it was not
until May 1977 that I wrote to the National Archives for a copy of these
records. Bounty land acts were first passed on 16 Sep 1776 and granted
land to veterans who had rendered service in behalf of the Unites States.
Bounty land laws served as inducement to foster enlistment and discourage
military desertions or resignations. Relatively few veterans applied
for a regular pensions, but few refused or failed to apply for and
receive a bounty land  warrant. The warrant was a negotiable intrument
and were often sold for their ready cash value to land speculators.
Reuben Finnell, the father of John, had recreived such a warrent for
land in Ohio because of his service in the Revolutionary War and he had
sold his warrant rather then leave Virginia. As the years passed and
land in the west became available by further Acts of Congress many
of the veterans of the War of 1812 became eligible for such warrents.
The records of the former General Land Office of the National Archives
shows that Militray Bounty Land Warrant 23870 for 80 acres by the Act
of 1850 was issued to John Finnell, Private, Captain Shackelford's
Company, Virginia Militia, War of 1812, John Finnell by now 73 years
old, sold this warrant to Peter Sanborn who used it, on 23 Aug 1853,
to locate the E1/2 SW1/4 Section 9 Twp 11N Range 13 W in the Lonia
Land District in Michigan. The records also show that Military Bounty
Land Warrent 10921, 80 acres Act of 1855, was issued to John Finnell,
Private, Captain Shackelford's Co, Virginia Militia, War of 1812. On
3 Mar 1856, John Finnell now 77 years old sold this Warrant to Elias
A. White who used it on 20 Aug 1858 to locate the E1/2 SE1/4 Section 32,
Twp 85N, Range 34W in the Council Bluffs land District in Iowa. I do
not know what amount of money John Finnell received from the sale of
his bounty land. Many of the veterans of the  War of 1812 disposed of
their land in this manner as most of them were too old to remove to
such remote western lands for permanent settlement.
     JOHN FINNELL, the son of Reuben and Hentietta Finnell departed this
life on Wednesday, 17 Sep 1862 at his residence near Flint Hill in
Rappahannock County, Virginia, age 83 years 6 months and 7 days. He was a
member of the Methodist Episcopal Church 28 years, 11 months. He died from
paralysis. His was a peaceful death. He was a faithful man of God. He was
buried near his residence on 19 Sep 1862 in an old graveyard on Gordon
Manor. His life had spanned more then 83 years from the time  of the
Revolution to the Civil War. He had seen many changes in his state of
Virginia and had helped mold the new county of Rappahannock.
     ELIZABETH FINNELL departed this life on Wednesday, 14 Jan 1874
at her home near Flint Hill in Rappahannock County, Virginia age 89 years 6
months and 10 days. She had survived her husband by 11 years and 4 months
She had been a member of the M.E. Church  for 40 years and 2 months. She
died a faithful mother and christian, beloved by all who knew her. She  was
buried by her husband in an old graveyard on Gordon Manor near their
residence.
     We found no will or probate record for John or Elizabeth B. Finnell
among the records in the Court House at Washington, VA

     Notes to Eva Gorman Finnell's Article on John Finnell of
                    Rappahannock County, VA
    

     1 Neither family tradition nor D.A.R. records
have given a surname for Henrietta. She may have been a Thorn.The Finnell
and Thorn families were well acquainted and several intermarriages occured
among the members. My only shred of evidence that Henrietta was a Thorn is
found on the death record of Sarah [Sallly] Finnell Murphy in Monongalia
County, West Virginia. Sally was born in Culpeper County in 1788 the
daughter of Reuben (1750-1823) and Henrietta. She married H. D. [Hugh]
Murphy who was at least 17 years her junior.
They moved to Monongalia County (then Virginia) where she died near
Morgantown on 2 March 1857 aged 69 yrs. Her death record lists her as born
in Virginia and names her husband as H.D. Murphy. The space for the names
of her parents shows a blank space and then the single surname of Thorn is
listed. I have found no evidence that the Murphys ever had any children.
It was from the census records I learned of their age difference. In 1850
he was a farmer in Monongalia County, aged 45 years and she was 62 years.
In the 1860 census Hugh D. Murphy, 52, was a grocer and lived with Charles
W. Finnell (Half-brother of Hugh's wife Sally) in the Hotel that Finnell
operated in Morgantown. More thorough into the Thorn family will perhaps
provide the complete proof we need of the surname of Henrietta Finnell

     2 This population for Washington, Virginia was taken from the 1970 census

     3 Elizabeth Burch Thorn was the daughter of
Peregrine Thorn. He is listed in the 1810 census of Culpeper Vounty, but we
did not find a will or estate settlement for him in Culpeper. There was,
however, a will for his son, Justinean P. Thorn (Will Bk K, page 47) recorded
2 Feb 1825. A summary of that will is as follows. In the name of God, I.
Justinean Peregrine Thorn of the County of Culpeper request...1. All debts to
be paid. 2. Bequeath unto Mary C. Jordan and Adaline Singleton a full suit of
mourning Is it possible that Adaline Singleton was the daughter of
Justinean's sister, Dolly Singleton, and thus his niece? She would have
been 10 years old at the time of this will. She later married Justinean
Finnell on 1 Feb 1838 in Rappahannock County. If this is true Adaline
and Justinean were first cousins. This needs more research. 3. To my
sisters Elizabeth Finnell (Johns wife), Martha Finnell (Robert's wife)
and Dolly Singleton a full suit of mourning. 4. The rest of my estate
to my wife Margaret C. Thorn The will was dated 25 Oct 1824. Justinean
P. Thorn had a estate valued at $1000. We found no land purchase for Thorn
in Culpeper County

     4 Charles W. Finnell, half brother to John,
was married first to Elizabeth Thorn in Feb 1815. She died 10 Dec 1823. They
had two sons, George and Ashford. Both children died young and left no issue.
I do not know the relationship of this Elizabeth Thorn Finnell to Elizabeth
Burch Thorn Finnell. It is probable that Elizabeth, wife of Charles W., was
the daughter of Sarah Thorn. At Woodstock in Shenandoah County, Virginia in
Deed Book CC, Page 528 is recorded a deed dated 12 Jan 1824 between
William Thorn and Lewis Menefee and Amelia, his wife late Amelia Thorn
(William and Amelia were children of Sarah Thorn Dec'd.) and Charles W.
Finnell. For the Sum of $120 Finnell purchased the chattals (including a
negro) of the late Sarah Thorn. This was signed by William B. Thorn, Lewis
Menifee, Melissa Menifee & Charles W. Finnell in the presence of John Finell,
Thomas Finnell & Catherine Menifee. Remember, Elizabeth had died about
one month prior to this so she would not be mentioned in the deed. Sarah
Thorn had appeared in the 1810 census of Culpeper, as had Dolly, George,
John, William and Peregrine

     5 At this time I believed the older John
Finnell is the same John who lost much of his lands and personal possessions
in Sheriff's sales in Culpeper County in the late 1820's and early 1830's.
Culpeper Deed Book 4, page 95 lists Charles J. Finnell as the son of John W.
and Elizabeth Finnell. Culpeper Deed Book 5, page 109 tells that Charles J.
Finnell was living in Clay County, IL at the time of the record on 22 Dec
1865. At one time I had thought that Charles J. was the son of John and
Elizabeth Burch Thorn Finnell but the list of children from Lillie Finnell
does not list him. He is the son of the older John Finnell of Culpeper
County. The older John had 31 1/4 acres of land in Culpeper County lying
on the east side of the Fredericksburg Road. Culpeper Deed Book 15,
page 110, recorded 22 Dec 1865, states that John Finnell lived there at
the time of his death. Page 109 of the same book says that the land in
Culpeper County is on the turnpike leaving from Fredericksburg to Winchester
and that Catherine Finnell lives there on the 22 Dec 1865 date. A brother
to Charles J. and Catherine Finnell is John Wm. John Wm Finnell married
Martha B. Bohon (of a Early Orange Co., Va family) on 28 Oct 1841 in
Mercer County, KY. This couple founded the Finnell line at Salvisa in
Mercer County, KY. John Wm Finnell was born c1811 in Virginia

     6 In the Orange County petitions of 19 Nov
1777, Thomas Finnell of that County tells of the service of his two sons:
Reuben in the continental service and John in the Minute service. He asked
for reimbursement for the care and nursing he gave to them during the winter
of 1776 when they were lifing in the father's home too sick to serve their
tour of duty with the army. He was granted payment for the care of John but
not for Reuben

     7 Henrietta Compton was the widow of
Walter Compton of Culpeper County. On 15 Oct 1796 (Culpeper Deed Book T,
page 21) Walter Compton purchased from William Mark Harper & Zillah, his
wife, land for 60 pounds 6 shillings. The description mentions Presley
Thornston's line, on a branch of a river, and William Clark's land. The deed
refers to the price paid but not the acres. 16 July 1904 (Deed Book 2, page
41) Walter Compton purchased from Enoch Furr and Susannah, his wife, 11 acres
for $600 being part of a tract Notty Maddox now lives on. It mentions Wither's
line, on the state road from Winchester to Richmond. The sale of the above
land was recorded in Deed Book HH, page 20. It was 122 acres and mentions
Presley Thornton's line and Harpers Tract. It sold to Stephen Compton for
$116. By reading the Compton deed records we know that the land was in what
is now Rappahannock County and near Flint Hill. The state road from
Winchester to Richmond is now U.S. 522 and passes through present day Flint
Hill. Thornton and Compton lines are often mentioned in the deeds for the
land belonging to John Finnell.
     Will Book E, page 271 of Culpeper County gives the inventory of the
estate of Walter Compton. It includes 5 slaves and the estate totaling
$2049.79. Henrietta was the administratrix of the husband's estate. It was
Henrietta Compton who provided in her will dated 14 Oct 1816 for land to
build a Methodist Church on and for the future support of that church. John
Finnell was one of the Trustees of this church. Unfortunately the actual will
was recorded in one of the record books of Culpeper County that disappeared
during the Civil War. Thus the only record of this may be in the Rappahannock
County Deed Book B, page 327-328. This indenture was made the 27th day of
May 1835 between John Finnell, Toliver P. Grantham, Benjamin McDougle,
George B. Fant and George Moor, Trustees of the Methodist Church in the
County of Rappahannock and Moses Gibson. The record states that it was the
wish of Henrietta Compton that certain estate, real and personal, under the
residuary clause of her last will and testament be appropriated toward
building a Methodist Meeting house and for the support of the Methodist
Church. It further states that the title of this property "has been long in
dispute", and suit long pending in the Circuit Superior Court of Law and
Chancerty for the Fredericksburg District; and whereas heavy expenses have
already accrued, and further expenses are likely to accrue, all of which has
been defrayed by the aforesaid Gibson, and whereas it is doubtful whether
a title to the property will ever be recovered, and the Trustees aforesaid
being anxious to secure some benefit to the church; under the aforesaid
Devise, and to relieve themselves and Church from the trouble and vexation
incidental to a tedious Lawsuit". The trustees agree to receive from Moses
Gibson $100 for which they gave him any interest in the land that had been
left them by Henrietta Compton. If he could gain title to the land it would
be fine but at least the Church was relieved of any legal bligation regarding
the property. It would be interesting to follow the land and see if Moses
Gibson ever gained clear title. This might pinpoint the exact location of the
said land, also

     8 Reuben Finnell purchased 1 sow for $1.67. I
do not know if this was Reuben the Father or Reuben Ellis, his son from the
second marriage. The older Reuben was still living at this time. He was 72
years old and this sale took place one year and five months before his death.
Reuben Ellis married Vienna Russell in 1816. On 5 Dec 1816 he purchased
from Elisha E. Russell and wife 200 acres for $600. lying on Happy Creek in
Shenondoah County (Shenandoah County Deed Book X, page 372-373). In
1836 this Happy Creek area became a part of the new County of Warren. The
200 acre farm of Reuben Ellis Finnell lay several miles north of the
Flint Hill area, but it would not have been impossible for him to have
attended the Compton sale

     9 Robert Finnell, son of Reuben, brother to
John and husband to Martha Thorn finnell was 45 years old at this time. He
later moved his family to Monongalia County, VA. They lived south of
Morgantown at Granville, now known as Mona, WV

     10 Thomas Finnell purchased 1 chest for 75
cents and one old bench for 25 cents at the Compton sale. Reuben Finnell had
a son by his second marriage to Sarah Ashford Mitchell who was born c1805
and was named Thomas Jonathan. [editor: This is per the DAR papers in
Washington DC] John and Elizabeth Burch Thorn Finnell's oldest child and son
was Thomas T. Finnell, born 4 April 1805. He married Sarah Menefee in
Culpeper Co, 23 Mar 1830 and 1840 was living in Rappahannock County. He
would have only been 17 years old at this time. There is also a Thomas
Finnell born between 1795 and 1802 who was born and lived in the area at
this time. He married 1823 to Nancy Compton, the daughter of George and
Sarah Duke Compton. This Thomas would have been about 20 years old at the
time. Families of these surnames migrated to Coshocton County, Ohio with

     11 Bazil Gordon is often referred to as
Virginia's first milionaire. Natives of Scotland they settled in Virginia in
1786 and became eminently successful merchants. He died in 1847. During the
years that Bazil Gordon was guilding his fortune, long trains of covered
wagons of Rappahannoch farmers, rolled down the old Falmouth Road carrying
their produce to Gordon's place of business. I have always felt that John
Finnell must have been one of the most enterprising of these farmers or
wagoners since he was taxed as the owner of 12 head of horses or mules in
the 1833 Property Book of Rappahannoch County. This placed him among the
owners of the largest number of such animals at that time

     12 I do not know the identity of this Thomas
Finnell. It is very possible that it is the oldest son of John and Elizabeth
B. Finnell, born Sunday, 4 April 1805. He married on 23 March 1830 in
Culpeper County to Sarah Menefee. This same Thomas was found engaged in
farming in the 1840 census of Rappahannoch County. By 1850 Thomas and his
Family had moved west to Taylor County, Virginia where he was listed as a
road contractor

     13 John A. Finnell born Saturday, 29 August
1807 was the son of John and Elizabeth B. Finell. Rappahannock County Deed
Book G, page 156-157 reads: "John A. Finnell of the County of Rappahannock
to John H. Settle regarding three notes." Finnell was indebted to Jett,
Reid & Co for $85.56 secured by two notes. In Deed Book G, pages 249-250
John A. Finnell's property was sold under a Deed of Trust. It lists property
and buyers. In Warren County Marriage Book A, page 11 on 3 Feb 1846 John A.
Finnell married Nancy Settle. The minister was T.D. Herndon, a Missionary
Baptist minister. In the 1850 census of Jefferson County, Virginia in the 28th
district taken on 21 August John A. Finnell was 42 years old and a laborer.
Ann Finnell, his wife, was 29 years. the children: Catherine 3 years, Emily
1 year and Mary H. 5/12 years. In the 1860 census of Clarke County Virginia,
Millwood post office John A. Finnell was a 52 year old laborer. Nancy his
wife was 37 years old. The children: Catherine 13 year, Emily 11 years,
Henrietta 10 years, John T. 8 years, Nannie B. 6 years, Rosa B. 5 years,
Vincent 3 years and Luther 1 year. Warren County Marriage Book B, page 40
lists a marriage license on 21 November 1883 for Hanry C. Trail to Hettie J.
Finnell. He was 25 years old and born in Warren County. She was 21 years old
and born in Clarke County, the daughter of John and Nancy Finnell

     14 Justinian Finnell was born Monday, 28
May 1810, the son of John and Elizabeth B. Finnell. He was named for his
uncle, Justinian Peregrine Thorn, brother to Elizabeth B. Thorn. Justinian
always lived by John the father as found in the Rappahannock County census.
He had an aunt, sister to his mother named "Dolly Singleton". He married
Adaline Singleton. She may have been a cousin. In 1870 census Justinian lived
in Clarke County near White Post where he worked on a farm. He named a son
John B. Finnell
