1851 Declaration Form

State of Georgia, County of Henry

On the fifth day of March, A.D. one thousand eight hundred and fifty-one personally appeared before me, Isaac Welden, a Justice of the Peace duly authorised [sic] to administer oaths within and for the County and State aforesaid, Joshua Evans, aged 67 years, a resident of Henry County in the State of Georgia, who being duly sworn according to law, declares that he is the identical Joshua Evans who was a Private Soldier in the company commanded by Captain John Wilson in the Georgia Regiment of draughted [sic] soldiers commanded by E. Wimberly in the war with Great Britain and the United States, and that he was draughted in Jasper County, Georgia, on or about the 21st day of November, A.D. 1814 for the term of six months, and continued in actual service in the said war for the term of three months and 17 days, and was honorably discharged at Darien, Ga. on the eighth day of March, A.D. 1815 by reason of peace being declared, as will appear by his discharge and the muster rolls of the said company.

He makes this declaration for the purpose of obtaining the Bounty Land to which he may be entitled under the "act granting bounty land to certain officers and soldiers who have been engaged in the military service of the United States," passed September 28, 1850.

Sir:

The regulations of this office require, that in every case of application for Land Bounty, under the Act of September 28, 1850, the original certificate of discharge be presented and filed with the claimant's declaration. If lost or destroyed, or if the claimant never received a written discharge, or if discharged in consequence of disability, or if he was in captivity with the enemy, the facia must be stated, verified, and authenticated, as in the case of the declaration.

The discharge of Joshua Evans not having been received, nor its absence satisfactorily accounted for in his declaration filed by you, a further examination of his claim is necessarily suspended until the regulations referred to above are complied with.

1855 Declaration Form

On this seventeenth day of March, A.D. one thousand eight hundred and fifty-five, personally appeared before me, Jason Burr, a Justice of the Inferior Court, duly authorized to administer oaths within and for the County and State aforesaid, Joshua Evans, aged seventy-one years, a resident of Spalding County in the State of Georgia, who being duly sworn according to law, declares that he is the identical Joshua Evans who was a Private in the Company commanded by Captain John Wilson in the Georgia Regiment of drafted men commanded by Ezekiel Wimberly in the war of 1812, that he was drafted at Regimental Muster Ground, Jasper County, Georgia on or about the first of [?] of A.D. 1814 for the term of six months, and continued in actual service in the said war for the term of about four months, and was honorably discharged at Darien, Georgia on the eighth day of March, A.D. 1815 on account of peace being made, as will appear by the muster rolls of the said Company.

Having presented his discharge with his former declaration, he makes this declaration for the purpose of obtaining the bounty land to which he may be entitled to under the "act granting additional bounty land to certain officers and soldiers who have been engaged in the military service of the United States," approved March 3, 1855. And refers to his former declaration made under act of 1850, upon which he obtained a Land Warrant No. [not recollected], for forty acres, which he having legally transferred and disposed of, is not within his power now to return.

He further declares that he has not received a warrant for bounty land under any other act of Congress, nor made any application therefor, than the one above referred to, under act of 1850, upon which he obtained the said Land Warrant No. [not recollected], for forty acres, and the one now presented.

On this 1st day of July, A.D. one thousand eight hundred and seventy-eight personally appeared before me, John J. Hunt, Ordinary, the same being a Court of Record within and for the county and State aforesaid, Harriett Evans, aged sixty-one years, a resident of Pike County, in the State of Georgia, who, being duly sworn according to law, declares that she is a widow of Joshua J. Evans, deceased, who was the identical Joshua J. Evans, who served under the name of Joshua J. Evans or Evens as a Private in the company commanded by Captain John Wilson, in the regiment of [?], commanded by [?] in the war of 1812; that her said husband was drafted at Monticello, Jasper Co. on or about the [?] day of [?], A.D. 1814, for the term of six months, and continued in active service in the said war for the term of five months, and whose services terminated, by reason of close of the war, and was thought to be at home on furlough, does not know definitely where he served, thinks about Darien or Tybee Island, was honorably discharged, A.D. 1815. She further states that the following is a full description of her said husband at the time of his enlistment, viz: born in Delaware, five feet six or seven inches high, black hair, blue eyes, fair complexion, was farmer about thirty-two years old. She further states that she was married to the said Joshua J. Evans, at the city (or town) of near Liberty Hill Post Office, in the county of Pike, and in the State of Georgia, on the [?] day of March, A.D. 1855, by one John Gossitt, who was a Justice of the Peace, and that her name before her said marriage was Harriett Baird, and that she has not remarried since the death of the said soldier; and she further states that her husband had been previously married to Rebecca Smith who died in June 1854 in Spalding County, and that her said husband Joshua J. Evans died at his home in Spalding Co., in the State of Georgia, on the [?] day of July, A.D. 1864; and she further declares that the following have been the places of residence of herself and her said husband since the date of his discharge from the Army, viz: last lived near Griffin in Spalding County, moved from Jasper where he resided at time of entering service, had previously moved from his native state of Delaware to Hancock Co. and thence to Jasper. She makes this declaration for the purpose of obtaining the pension to which she may be entitled under the provisions of Sections 4736 to 4740 inclusive Revised Statutes, and the Act of March 9, 1878, and hereby constitutes and appoints with full power of substitution and revocation, Tucker & Bishop, of Washington, D.C., her true and lawful attorneys, to prosecute her claim and she further declares that she has heretofore made application for land warrant which was granted, + with this application his discharge was sent to the office at Washington D.C., and that her residence is near Liberty Hill P.O., county of Pike, State of Georgia, and that her post-office address is Liberty Hill Pike Couonty, Georgia.

In the matter of Harriet Evans, applicant. Personally came before me, a Justice of the Peace in and for the aforesaid County and State, J.P. Brown, aged 50 years, a citizen of the County of Pike, State of Georgia, whose Post Office address is Liberty Hill, Ga., and David G. Burk, aged 32 years, a citizen of the County of Pike, State of Georgia, whose Post Office address is Liberty Hill, Ga., well known to me to be reputable and entitled to credit, and who being duly sworn, declare in relation to the aforesaid case, as follows:

Joshua J. Evans died in the month of July 1864. Knew he + Harriet Evans as man and wife five or six years. Know that Harriet Evans has not married since the death of her husband Joshua J. Evans. We live in the same neighborhood and have for ten or fifteen years.

We further declare that we have no interest in the said case, and are not concerned in its prosecution.

And you are hereby required to return this License to me, with your Certificate hereon of the fact and date of the Marriage.

On this 23 day of May, A.D. one thousand eight hundred and eighty-one, personally appeared before me, Ordinary of same county, the same being a court of record within and for the county and State aforesaid, Harriett Evans, aged 64 years, a resident of Pike, in the State of Georgia, who, being duly sworn according to law, declares that she is the widow of Joshua J. Evans, deceased, who was the identical Joshua J. Evans, who served under the name of Joshua J. Evans as a Private in the company commanded by Captain John Wilson, in the [?] regiment of Georgia Troops, commanded by [?] in the war of 1812; that her said husband enlisted at Monticello, Jasper Co., Ga. on or about the [?] day of [?], A.D. 1814. She further states that the following is a full description of her said husband at the time of his enlistment, viz: five feet 8 in. high, black hair, blue eyes, fair complexion, by occupation a farmer. She further states thatshe was married to the said Joshua J. Evans, in the county of Spalding, and in the State of Georgia, on the 8 day of February, A.D. 1855 by one John Gossett, who was a Justice of the Peace; and that her name before her said marriage was Harriett Baird; and she further states that her husband had been married before to Rebecca R. Smith who died in Spalding County, Georgia, July the 30, 1854, and that her said husband Joshua J. Evans died at Spalding County, in the State of Georgia, on the 8 day of July, A.D. 1864, and she further declares that the following have been the places of residence of herself and her said husband since the date of his discharge from the Army, viz: in Jasper Co., Ga. for a few years, then moved to Henry Co., and then to Pike Co., Ga. where he died, but in 1850 or 1852 the place he lived in Pike Co. was cut off into Spalding Co., Ga. She makes this declaration for the purpose of obtaining the additional bounty land to which she may be entitled under the act approved March 3, 1855; and she further declares that she has heretofore made an application for a pension and is now receiving it. Certificate No. 18.758, and that her residence is [blank], and that her post-office address is Liberty Hill in the County of Pike, State of Georgia.

Baird, aged 49 years, residing in Pike Co., Ga., persons whom I certify to be respectable and entitled to credit, and who, being by me duly sworn, say that they have known the said Harriett Evans for 30 years and for 30 years, respectively; that they were present and saw her make her mark to the foregoing declaration; that they have every reason to believe, from the appearance of said claimant and their acquaintance with her, that she is the identical person she represents herself to be; and they further say that they are able to identify her as the person who was the wife of the identical Joshua J. Evans, who rendered the service alleged in the above application in the company of Captain Wilson in the war of 1812 by the following named facts and circumstances, viz: they lived by them from the time of their marriage up to his death, and it was always so reputed in the neighborhood; they hath known that the first wife of Joshua J. Evans is dead; they lived near the family when she died and it was then so reported, and has been so reputed ever since; they both saw Joshua J. Evans after he was dead; and that they have no interest in the prosecution of this claim.
