Whereas James Hazlerigg stands bound as my security --J. Peters in one note of hand for one hundred and twenty five dollars due the first day of January 1843 also in one other note to said Peters for one hundred and ten dollars due the first day of January 1845. And whereas I stand indebted unto said James Hazlerigg in one note of hand for one hundred and forty nine dollars and some cents due in the month of January last, also in one note due the first day of January 1844 for one hundred and twenty five dollars also one other note for one hundred and forty one dollars and eighty cents, due the first day of January 1846 and whereas I am desirous to save and secure the said James Hazlerigg from any liability on account of the securityship aforesaid and to secure the prompt and faithful payment of the amount of said three notes due as aforesaid to said James G. Hazlerigg. Now this indenture witnesseth that for the purpose aforesaid I have and do by these presents deed and mortgage to said Hazlerigg the following lands and tenements. To Wit: Three undivided tenths of all that tract of land situate in the County of Bath and on Slate Creek, it being the same tract of land on which my father David Cartmill died. The entire tract of land supposed to contain one hundred and thirty five acres, one tenth of which I hold as one of the heirs, one tenth by purchase from my brother Thomas Cartmill and one tenth by purchase from James Payne and Eliza, his wife, late Eliza Cartmill, who is also one of the heirs. Also one other tract of land including some Town Lots in and adjoining the Town of West Liberty, Morgan County, the amount not precisely known but for a full and complete description of said lotts and land---is had and made to the deed of conveyance of IGTF? & J.W.Hazlerigg to said William H. Cartmill and of record in the Morgan County Court Clerks office now in the-------of said Hazlerigg having the aforesaid debts of Peters or part of the same to pay in case of my failure to pay to him said Hazlerigg the aforesaid notes or any part of the same, then is to have the right to foreclose this mortgage and have the aforesaid lands or so much thereof sold as will be sufficient to satisfy and pay the said debts in any part of the same which may be due and unpaid.

I James Howard Clerk of the Court of the County aforesaid do certify that this deed of mortgage, William H. Cartmill to James G. Hazlerigg was this day produced to me and acknowledged by said Cartmill to be his act and deed hand and seal for the purpose therein contained all to which to the Clerk of the Bath County in which County apart of the premises be, also to the Clerk of the Morgan County Court, there also to be recorded in which apart and the remainder of the premises also be. Given under my hand this 17th day of February 1842
