17 APRIL 1803



This indenture made the 17th day of April in the year of our Lord one thousand eight hundred and three between John Warwick, attorney in fact, for Thomas Cartmill of the State of Kentucky and county of the one part and John Sutton of Bath County and State of Virginia of the other part.

Witnesseth that the said John Warrick as attorney aforesaid for and in consideration of the sum of twelve dollars in hand paid to the said Thomas Cartmill at or before the sealing of these presents, the receipt whereof he doth hereby acknowledge have bargained and sold and by these presents doth bargain and sell unto the said John Sutton and to his heirs, one certain tract or parcel of land lying and being in the said County of Bath, containing two hundred and seventy three acres and bounded as followeth.

Beginning at three white oak saplings on the top of a high hill, thence South eighty one degrees, East thirty four poles crossing the Spring branch to a white oak and hickory on a little hill, thence North ten degrees, East twenty two poles to two white oaks corner to James Tanner's now Charles Donovan, thence with the said line of Donovan North thirty three degrees, East one hundred and two poles to a white oak and Spanish Oak saplings corner to said Donovan, thence with his line south sixty degrees, East forty poles to a chestnut and two white oaks at the foot of a hill, North thirteen degrees, East three hundred and sixty poles leaving said Donovan line and crossing several hills to two chestnuts and a hickory on the top of a hill, North seventy two degrees, West one hundred poles to a large white oak and two hickorys on a hill and corner to land now Jacob Warwick's, and with his line South ten degrees, East one hundred poles to an ash and two black oak saplings. South fifty seven degrees, West twenty poles to two black and white oak saplings on said Warrick's line, South seventeen degrees, West three hundred and seventy poles to the Beginning.

To have and to hold the said John Sutton and his heirs and the said John Warrick as attorney for the said Thomas Cartmill and his heirs the said tract or parcel of land with all its appurtenances unto the said John Sutton and to his heirs and assigns to the said John Warrick as attorney in fact for the said Thomas Cartmill and his heirs the said tract or parcel of land with all its appurtenances unto the said John Sutton and his heirs and assigns against all persons whatsoever will forever warrant and defend.

In Witness whereof the said John Warrick as attorney in fact for the said Thomas Cartmill hath hereunto subscribed his name and affixed his seal this day and year first above written.
