Cartmill to Cartmill Deed
This indenture made and entered into this thirtieth day of January 1827 between John Cartmill and Rebecca, his wife of Bath County, Kentucky of one part & Thomas Cartmill of the same County and State of the other part. Witnesseth that the said John Cartmill and Rebecca, his wife for and in consideration of twenty five hundred & forty two dollars & seventy six cents to them in hand paid by the said Thomas Cartmill, the receipt of which is hereby acknowledged do by virtue of these presents grant & bargain sell & convey to the said Thomas the two following tracts of land. To wit-first one tract of one hundred & twenty six acres lying and being in the County of Bath on the waters of Hingston & Flat Creek, it being part of a leasing warrant patent originally granted to Robert Fryer and conveyed by him to the said John Cartmill and bounded as follows: Beginning at a hickory beginning corner of said Robert Fryer survey and north east corner of Enoch Smiths survey of 1000 acres and thence N 5 degrees E 146 poles to an elm and black ash corner with Joseph King thence West 147 poles to a cherry tree & white oak thence S 5 W 134 poles to two ash trees & sugar tree thence S 85 degrees East 146 poles to the beginning.
Secondly a tract containing by estimation fourteen acres lying inthe same county & on the same waters and adjoining the foregoing tract of 126 acres and bounded as follows: Beginning at a hickory beginning corner of the foregoing tract and also of Enoch Smiths 1000 acre survey, thence West with said Smiths line to John Jones line and with said line South to Cal W. Millers line of six hundred acres thence East with said line to -----line--------
thence to the beginning to have and to hold the said two tracts of land to him the said Thomas, his heirs and assigns--------forever. And they the said John Cartmill & Rebecca for themselves their heirs & assigns covenant to warrant the same to the said Thomas & his heirs free from them and their heirs and all persons claiming the same by, through or under them but not against any other persons or claims whatever.
