Friar to Cartmill Deed
This indenture made the second day of October in the year of our Lord one thousand eight hundred and six between Robert Friar and Jane, his wife, of the County of Montgomery, Fayette and Commonwealth of Kentucky of the one part and John Cartmill of the County of Montgomery and Commonwealth aforesaid of the other part. Witnesseth that the said Robert Fryer and Jane, his wife in consideration of the sum of one hundred dollars lawful money of the United States to them in hand paid, the receipt whereof they do hereby acknowledge and forever acquit and discharge the said John Cartmill, his heirs, executors and administrators, hath granted, bargained, sold, aliened and confirmed unto the said John Cartmill, his heirs and assigns forever all that tract or parcel of land situate, lying and being in the County of Montgomery aforesaid and the waters of Hingston and Flat Creek, it being part of a leasing warrant patent originally granted to the said Robert Fryer by patent bearing date December 2nd 1785 and is bounded as followeth. Vz: Beginning at a hickory beginning corner of said Robert Friar's survey and the North East corner of Enoch Smith's survey of one thousand acres and running thence North five degrees, East one hundred and fifty six poles to an Elm and black ash corner with Daniel Dean, thence West one hundred and fifty seven poles to a cherry tree and white oak, thence South five degrees West one hundred and thiryt five poles to ash trees and sugar tree, thence South eighty five degrees East one hundred and forty six poles to the Beginning. Containing one hundred and twenty six acres. Together with all and singular the premises and every part and parcel thereof with every of the appurtenances to the only proper use and behoof of him the said John Cartmill, his heirs and assigns forever. To have and to hold the said tract or parcel of land with every of the appurtenances unto him the said John Cartmill, his heirs and assigns forever and they the said Robert Fryar and Jane, his wife, do covenant, promise and agree with said John Cartmill, his heirs and assigsn forever by these presents that the premises before mentioned now and forever hereafter should remain free of and from all former and other gifts, grants, bargains, sales, dower rights and title of Dower Judgments, Executions, titles, troubles, charges and incumbrances, whatsoever done and suffered to be done by them the said Robert Friar and Jane, his wife, and their heirs doth and will warrant and forever defend the said land and premises from themselves and their heirs and all and every other person or persons rightfully claiming any right or title, thereto shown their heirs but not from any other person for the said Robert Frier & Jane his wife------the said John Cartmill byes the said tract of land at his own risk & the said Robert Fryor is only to refund one hundred dollars without interest, costs or damages should the said land be lost. Witnesseth whereof the said Robert Friar and Jane, his wife, hath hereunto set their hands and seals the day and year first above written.
