Green to Cartmill Deed

This indenture made this 25th day of August in the year of our Lord one thousand eight hundred and three between Willis Green of the County of Lincoln and State of Kentucky of the one part and Andrew Cartmill of the County of Montgomery and State aforesaid of the other part. Witnesseth that the said Willis Green for and in consideration of the sum of one hundred dollars to him in hand paid by the said Andrew Cartmill, the receipt whereof he doth hereby acknowledge, hath granted, bargained and sold and by these presents doth grant, bargain and sell, alien & confirm unto the said Andrew Cartmill and his heirs and assigns forever, two certain tracts or parcels of land situate, lying and being in the said County of Montgomery on the waters of Prickley Ash, the same being part of Jacob Myers Survey of 5000 acres, one of which said tracts is bounded as followeth. To Wit: Beginning at a beech and elm in the line of said Myers survey of 5000 acres, thence South 70 degrees East crossing a branch 136 poles to two beeched on the North side of a hill, thence North crossing Prickley Ash Creek 152 poles to an elm, ironwood and blue ash on a ridge thence West 128 poles crossing a branch to a large and small elm on the East side of a ridge on the line of said Myers survey, thence by said line South 30 minutes East crossing Prickley Ash 108 poles to the Beginning, containing one hundred acres be the same more or less. The other of said tracts containing four hundred acres is bounded as followeth. To Wit: Beginning at the letter G, elm, hickory and buckeye standing on a branch, NorthWest corner of the original survey of 5000 acres made in the name of Jacob Myers, South 270 poles, corner to the aforesaid survey of 100 acres at H, thence East pusuing the line of said survey 130 poles to a corner thereof at E thence South 26 poles to two white oak and elm and D, thence East 104 poles

to a large elm, beech and sugartree. On the East side of a branch, thence North 298 poles to a stake in said Myers' line, thence with said line West 228 poles to the Beginning. To have and to hold the aforesaid tracts of 100 & 400 acres of land with all & singular the premises & appertenances and thereof unto the said Andrew Cartmill and his heirs and assigns forever. To the only proper use and behoof of him the said Andrew Cartmill and his heirs forever. And the said Willis Green for himself and his heirs doth hereby convenant and agree to and with the said Andrew Cartmill, that he will warrant and defend the land and premises hereby bargained and sold to him the said Andrew Cartmill, his heirs and assigns against the claim of all persons deriving title from him the said Willis Green. And the said Willis Green doth further covenant and agree that in case any part of the aforesaid of 100 acres of land should be lost by prior or better claims that he will refund to the said Andrew Cartmill at the rate of two dollars for each acre so lost, in cash with legal interest thereof from this date & being the consideration given for the same. And if any part of the aforesaid tract of 400 acres should be lost by prior or better claims that he will refund to the said Andrew Cartmill at the rate of one dollar for each acre so lost to be paid in good beef cattle or horsed at cash price, it being the consideration given for the same. In Witnesseth whereof the said Willis Green hath hereunto set his hand & affixed his seal the day and year first written.

Montgomery County Clerks Office 27th day of August 1803. This indenture of bargain & sale from Willis Green to Andrew Cartmill was acknowledged by the said Green to be his act and deed whereupon a copy of the same remains on record.
