French to Cartmill Quit Claim Deed

This indenture made this 24th day of January year eighteen hundred and f

fteen between James French and Thereza, his wife of the County of Montgomery and State of Kentucky of the one part and David Cartmill of the County of Bath and State aforesaid of the other part. Witnesseth that the aforesaid James French and Thereza, his wife, for and consideration of the sum of one dollar. Hath grant, bargained and sold by way of Quit Claim and by these presents doth grant, bargain and sell by way of Just Claim unto the said David Cartmill, his heirs and assigns, forever all the estate, right and title of them the aforesaid James French and Thereza, his wife, in and to a certain parcel of land containing ninety seven acres be the same more or less, situate in the aforesaid County of Bath on the waters of Cassady's Creek, being part of a warranty of 5000 acres conveyed by James Garrard to whom the same was granted, to the aforesaid James French and the parcel hereby conveyed is bounded as followeth. To Wit: Beginning at three walnuts and Iron wood corner to Benjamin Runnyonn's, thence East 81 poles to a sugar tree, beech and Ironwood, Thence South 195 poles to an ash, hickory and Ironwood in McClain's line, thence West with his line 79 poles to three sugars in said line, thence North crossing Runnyun's corner and with his line 196 poles to the Beginning. To have and to hold th=

e parcel of land aforesaid with its' appertenences unto the said David Cartmill, his heirs and assigns forever and the aforesaid James French and Thereza, his wife, doth by these presents warrant and will forever defend the parcel of land aforesaid with its' appertenences by way of Quit Claim unto the said David Cartmill, his heirs and assigns forever against themselves, the aforesaid James French and Thereza, his wife, and their heirs but from nor against no other person or claim whatsoever. And the said David Cartmill hereby declares himself fully satisfied and content with the title of the aforesaid James French, at all chances adn by way of Quit Claim as aforesaid, and by these presents doth release and acquit the aforesaid James French and Thereza, his wife, and their heirs from all demand for or on account of the parcel of land aforesaid, whould the same later be taken away by any other person or claim whatsoever, whether now known or that may hereafter become known to conflict the therewith. In testimony whereof the aforesaid James French and Thereza, his wife, have set their hands and affixed their seals the day and year above written.

Sudduth deputy for Thomas Fletcher Clerk of the Court of the County aforesaid do certify that this deed of conveyance from James French to David Cartmill was this day proven before me by the oath of Mahlon Hall and Charles Hicklin. Witness thereto subscribed to be the act and deed of him the said James French for the purposes therein contained. Whereupon the same is hereby recorded in my office as the Law directs. Given under my hand as deputy aforesaid this 11th day of September 1815.
