Cartmill to Gregory

This indenture made this 12th day of June in the year of our Lord one thousand eight hundred and eleven between Andrew Cartmill and Nancy, his wife of Montgomery County and Commonwealth of Kentucky of the one part and James Gregory of the same place of the other part. Witnesseth that the said Andrew Cartmill and Nancy, his wife for and in consideration of the sum of twenty eight pounds fifteen shillings lawful money of Kentucky to them the said Andrew Cartmill and Nancy, his wife in hand well and truly paid the receipt whereof is hereby acknowledged, they the said Andrew Cartmill and Nancy, his wife hath granted, bargained and sold and by these presents doth grant, bargain & sell unto the said James Gregory, his heirs and assigns, a certain tract or parcel of land containing one hundred and fifteen and three quarters acres by survey bearing date February the twenty seventh one thousand and eight hundred and seven (1807) being part of a tract of five thousand acres entered & surveyed for Jacob Myers, lying & situate in the county aforesaid on the short fork of Whiteoak Creek, a branch of Slate Creek and bounded as follows:

Beginning at a large beach & buckeye corner to a survey made for William Bailey near a branch running thence North one hundred and forty poles to a White Walnut & two Sugartrees, thence East one hundred and forty seven poles to a Beach, Hickory and Mulberry, thence South one hundred thirty four poles to a White Walnut, Ash and Beach, thence West one hundred & twenty one poles to an ash on a branch, thence South seventy West twenty seven poles to the Beginning with its appertenances thereunto, belonging or in anywise appertaining of every part & parcel thereof & all the estate, title, right, interest, claim and demand whatsoever of them the said Andrew Cartmill & Nancy, his wife of , in or to the said land and appertenances and every part thereof unto the said James Gregory, him and his heirs & assigns forever & the said Andrew Cartmill & Nancy, his wife, for themselves & their heirs the said land & appurtenances & every part there of against them and their heirs & against all and every person or persons claiming by from or under them or either of them but against no other person or persons whatsoever & in case the said land or any part there of should be lost by any prior or better claim, in this case after the said land should be lost by due course in Law, the said Andrew Cartmill, vc. is to pary back and refund unto the said James Gregory, vc., the purchase money to wit: Twenty eight pounds fifteen shillings in good horses or mares, under eight years old at there real value in trade without interest. In witnesseth thereof the said Andrew Cartmill & Nancy, his wife, have hereunto set there hands and seals the day and date above written.

I Thomas Fletcher Clerk of the Court of the County aforesaid do hereby certify the this indenture of Bargain and Sale from Andrew Cartmill and Nancy, his wife to James Gregory was produced to me in my office on the 23rd day of September 1811 and acknowledge by the said Andrew Cartmill and Nancy, his wife, to be there act and deed. She being privately examined by me as the Law directs, relinquished her right of dower in the within mentioned tract of land. Thereupon the same is truly recorded in my office the day and year aforesaid.
