Cartmill to Cartmill Deed
This indenture made and entered into this 13th day of November 1843 by and between James Payne and Eliza, his wife, late Eliza Cartmill, Thomas Cartmill and Sena, his wife of the one part and William H. Cartmill of the County of Morgan of the other part . The parties of the first part being of the County of Bath. Witnesseth that the said party of the first part have this day for and in consideration of the sum of one dollar each to them in hand paid the receipt of which is hereby acknowledged. Have granted, bargained and sold unto the aforesaid pary of the second part and doth hereby convey to said party his heirs and assigns forever all the estate, right, title, interest from party claims or demand of them the party of the first part in and to a certain tract of land lying in the County of Bath on Slate waters it being the tract of land of which David Cartmill decd-------and possessed and upon which said Cartmill's widow now lives the quantity not certainly known but supposed to be about one hundred and fifty acres. It being land descended to the said Thomas Cartmill and Eliza Payne as two of the children and heirs at Law of said David Cartmill, decd. Now the said party of the first part intend herby to convey to said party of the second part his heirs and assigns forever all their estate, right and title in and to said tract of land and appurtenances thereunto the same being undivided to--- and to---unto the said William Cartmill his heirs and assigns forever free from the them said James Payne and Eliza his wife and Thomas Cartmill and Sena his wife and all others claiming by the right or under them or either of them they will surely forever warrant and defend tract from or against no other will they----.
In Witnesseth of which the said party of the first part hereunto set their hands and seals the date aforesaid.

I W.M.Sudduth Clerk of the County Court for the County aforesaid do hereby certify that this deed from James Payne and Eliza, his wife and others to William Cartmill was on this the 18th day of December 1843 acknowledged before W.M.Sudduth and of my deputies by said James Payne to be his hand and seal act and deed. And she the said Eliza Payne being examind by law privily and apart from her said husband declares that she did freely and willingly by sign, seal and deliver said---and acknowledged the same again therein and explained to her to be her act and deed and----not to retract it but consented that the same might be recorded. And the same was this day acknowledged before me by the said Thomas Cartmill to be his hand and seal act and deed----from the same hath been duly admitted to record in my office as the Law directs.
