Cartmill to Bailey Deed

This indenture made and entered into this seventeenth day of September one thousand eight hundred and thiry (1830) by and between Andrew Cartmill and Nancy, his wife, of the County of Bath and State of Kentucky of the one part and Edward Bailey of the County and Commonwealth aforesaid of the other part. Witnesseth that the said Andrew Cartmill for and in consideration of the sum of one hundred dollars in money and sixty dollars in a horse at his real value to him in hand, paid before the sealing and delivering of this indenture, the receipt whereof is hereby acknowledged, hath bargained and sold and by these presents doth grant, bargain, sell, alien ane confirm unto the said Edward Bailey, his heirs and assigns forever all that tract or parcel of land, situate, lying and being in the County of Bath on the waters of White Oak Creek, including the place whereon the said Edward Bailey now lives, being part of Willis Green's survey of 1000 acres and bounded as follows. Viz: Beginning at a honey locust and hackberry and running N 70 E 110 poles to a large beach and buckeye, thence North 140 poles to a white walnut and two Sugartrees on the side of a branch, thence West 95 poles to a hickory, thence South 184 poles to the Begin=

ning, containing one hundred acres to have and to hold the aforesaid tract or parcel of land as above described with all and singular the appertenances thereunto belonging or any wise appertaining unto the said Edward Bailey and his heirs forever to his and their only proper use and behoof and the said Andrew Cartmill for himself, his heirs vc. the said tract or parcel of land unto the said Edward Bailey, his heirs and assigns shall and will warrant and forever defend against the claim of all and every person whatever, claiming by, through or under him, his heirs or assigns, but nevertheless it is understood and agreed on, by and between the parties hereto that if said land shall hereafter be lost or taken away by any prior or better claim that then in that case the said Andrew Cartmill, his heirs and assigns is to pay back to the said Edward Bailey, his heirs or assigns the original purchase money without interest. In testimoney whereof I have hereunto set my hand and affixed my seal the day and date first above written. Signed, Sealed and Acknowledged in presents of us.

Commonwealth of Kentucky Bath County, To Wit:

I Robert D. Hart Deputy for William M. Sudduth Clerk of the County Court for said County do certify that this deed from Andrew Cartmill & Nancy, his wife, to Edward Bailey was on this day acknowledged before me by said Andrew Cartmill to be his act and deed and she, the said Nancy being by me examined separate and apart from her said husband, declared that she did freely and willingly seal and deliver said writing without the threats or persuasions of her said husband and the said writing being again shown and explained to her, acknowledged the same to be her act and deed. Whereupon the said deed together with the foregoing certificate hath been duly admitted to record in my office. Given under my hand this 18th day of September 1830.
