Cartmill & Wife to Donaldson Deed

This indenture made and entered into this 31st day of July 1830 between Andrew Cartmill & Nancy Cartmill, his wife, of the County of Bath and State of Kentucky of the one part and Alexander Donaldson of the County and State aforesaid of the other part. Witnesseth that for and in condsideration of the sum of Twenty three hundred and fifty six dollars and twenty five cents to us to be paid by said Alexander Donaldson, we have this day granted, bargained and sold and by these presents do convey unto said Alexander Donaldson all of the following tract or parcel of land lying and being in the County of Bath on the waters of Prickley Ash Creek and bounded as follows. To Wit: Beginning at a beech in the original line of Grimes survey thence S 70 East 142 poles to a beech Thence South 23 1/2 poles to a falin ironwood Thence South 87 E 59 poles to two sycamores on the Bank of Prickley Ash Thence North 10 E 80 poles to a Mulberry Thence N 24 W 88 poles to a white walnut Thence East 67 1/2 poles to an elm and beech thence North 159 1/2 poles to a Sugar, Hickory, Hackberry and Elm on Gregories line and with it N 89 W 108 poles to a blue ash on the side of a branch Thence South 70 W 26 poles to a Beech, Capt Bailey's corner 70 poles more to three little elms in the fence row thence South 16 poles to a red oak Thence South 35 W 13 1/2 poles to two white oaks Thence S 45 W to the intersection with Greens original line and with it to the beginning. Containing three hundred and sixty two acres and one half. To have and to hold the above described tract of land with its appurtenences unto him the said Alexander Donaldson, his heirs and assigns forever. The said Andrew and Nancy Cartmill will warrant and forever defend the above discussed tract of land with its appurtenences unto him the said Alexander Donaldson his heirs and assigns forever free from the claim or claims of all and every person or persons whatever, but it is completely understood by the parties to these presents that the said Cartmill resives a lien on said land for thirteen hundred and fifty six dollars twenty five cents the balance of the considersation money until the same is fully paid. And it is further understood that if the said land should be lost by any legal equitable claim that in that case said Cartmill is to refund the purchase money without interest and so in proportion for any part that may be lost at the rate of six dollars fifty cents per acre.

Commonwealth of Kentucky Bath County to wit:

I Robert D. Hart Deputy for William M. Sudduth Clerk of the County Court for said County do certify that this deed from Andrew Cartmill & Nancy, his wife, to Alexander Donaldson was on this day acknowledged by said Andrews Cartmill to be his act and deed and the said Nancy was examined by me privily and apart from her husband, who declared that she did freely and willingly deliver said writing and wished not to retract it and acknowledged the said writing again shown and explained to her to be her act and deed whereupon the said deed together with the foregoing certificate hath been duly admitted to record in my office. Given under my hand this 31st day of July 1830.
