Bailey to Cartmill Deed

This indenture made this twelfth day of December one thousand eight hunded and twenty six between John Bailey of the County of Bath and State of Kentucky of the one part and Andrew Cartmill, of the County and State aforesaid of the other part. Witnesseth that the said John Bailey, Jr., in the consideration of the sum of three hundred thirty one third dollars, paid to him in hand. The receipt where as is hereby acknowledged and he himself satisfied therewith, have bargained and sold and by these presents do bargain, sell and confirm unto the said Andrew Cartmill and to his heirs and assigns forever, a certain tract or parcel of land, containing fifty five acres, being part of a survey of one thousand acres, patented for Willis Green. Lying, situate and being in the County of Bath on the waters of Prickley Ash. Beginning at two blue ash trees in the line of Andrew Cartmill and runing thence South 152 poles to two hickorys and ironwood on the top of a ridge, Thence South 87 degrees East 58 poles to two sycamores and elm standing in the creek. Thence North 10 degrees East 80 poles to the Beginning. Together with all its rights and appurtenances. To have and to hold the said tract or parcel of land with all its rights and appurtenances to the only proper use and benefit and behoof of him the said Andrew Cartmill, his heirs and assigns forever. And the said John Bailey, Jr. do for himself and his heirs, covenant and agree with the said Andrew Cartmill, his heirs and assigns to warrant and defend the said tract or parcel of land against any person or persons claiming any right thereun to by virtue of the Willis Green right. And likewise to pay back the sum of three hundred dollars thirty three and 1/3 in gold or silver without interest if the said land should be taken by virtue of any prior claim.
