On 15 October 1997, Arben Imami, Minister
of State for Legislative Reform and
Relations with the Parliament, and Ray
Snider, Acting Head of Presence for the Organization
for Security and Cooperation in Europe (OSCE),
officially opened the Administrative Center for the
Coordination of Assistance and Public Participation
(ACCAPP) at the OSCE Presence in Villa 6, Tirana,
Albania. ACCAPP is responsible for organizing
national and international participation in the Albanian
constitution drafting process. ACCAPP will work
with Albanians and the international community to
facilitate technical assistance, collect and distribute
information, provide training, and organize polls and
civic education initiatives. ACCAPP does not
represent the interests of any particular party or
government.
Pursuant to the Decision 339 of the Albanian
Parliament, dated 3.9.1997, the Ministry of
Legislative Reform and Relations with the Parliament
invited three lawyers to assemble to form a
Coordinating Group to coordinate assistance and
public participation in the constitutional drafting
process. The Coordinating Group consisting of three
lawyers, Ardita Abdiu, Erinda Ballanca, and Scott
Carlson, developed the initial design for ACCAPP and
are responsible for its management. Ms. Abdiu is
sponsored by ABA CEELI; Ms. Ballanca is sponsored
by GTZ; and Mr. Carlson is sponsored by OSCE.
Additional material and administrative support is
provided by the OSCE and the European Union
PHARE Programme.
Liaison Function for Parliament and Technical Staff
A key function of ACCAPP will be serving as a liaison
for the Parliament and its Technical Staff. ACCAPP
will take requests from a member of the Parliamentary
Commission, a member of Parliament who is the
leader of a party group (Group Leader), and the
Technical Staff for materials, training, and other
assistance. These requests will then be distributed to
the various donors, NGOs, and experts available. In
addition, ACCAPP will assist in the formulation of
Parliamentary and technical reports for distribution
both within and without of Albania.
In accordance with Decision 339, it is anticipated that
the technical assistance will be arranged around the
following basic groupings:
Legislative: The composition,
formulation,
and administration of legislative powers.
Judicial: The composition, formulation,
and
administration of judicial powers.
Executive: The composition, formulation,
and
administration of central executive powers.
Local Government: The composition,
formulation, and administration of local
government powers.
Human Rights: The definition and protection
of human rights.
Liaison Function for NGOs and Donors
ACCAPP welcomes offers of assistance from Albanian
NGOs and international donors who would like to
provide materials, training, and other assistance. These
offers are shared with members of the Parliamentary
Commission and Technical Staff and, as appropriate,
other NGOs and international donors. Also, working
sessions are held with NGOs and international donors
to develop strategies and action plans for organizing
assistance and promoting public participation in the
constitution drafting process. This newsletter will
report on these activities on a regular basis to ensure
full coordination.
Within the Albanian community, there are NGOs and
associations that will take part in the constitution
drafting process. With their involvement in the
process, there will be: 1) better informed citizens'
participation in making a new constitution, and 2)
ownership upon the part of citizens in the final
constitutional product. These NGOs and associations
are invited to participate in commenting on all the
basic categories noted above. It is anticipated that the
NGOs and associations will be particularly effective
with the following:
Public Opinion Polls: both 1) periodically
to
measure improvement in citizen understanding
and awareness; and 2) on a case-by-case basis
to test public opinion on a particular
constitutional issue.
Civic Education: 1) issue forums: expert
debates on issues; political party debates
and
student debates; 2) televised issue forums,
debates, and telephone call-in shows; 3) radio
debates and telephone call-in shows; 4)
pamphlets on particular constitutional issues,
processes, and definitions; 5) community
meetings/discussions on the constitution in
the
various regions; 6) high school educational
initiatives; 7) university-level debates;
8)
constitutional papers prepared by experts
for
study and review by experts, lawyers,
university students, and law students; and
9)
essay writing contests.
On 26 September 1997, an international
donors meeting was convened at the OSCE
Presence in Tirana. Approximately, two
dozen assistance providers and embassies which had
previously expressed interest in legal reform initiatives
in Albania were invited. Minister Imami and Acting
Head of Presence Ray Snider opened the meeting and
introduced the Coordinating Group. The meeting then
reviewed the proposal for ACCAPP and potential
activities to be included in the upcoming constitution
drafting process. A number of basic areas were
identified where donor assistance would be necessary.

Council of Europe to Play a Key Role
The Council of Europe has committed to play
a key role in the drafting process. In
particular, the Council intends to participate
through its European Commission for Democracy
Through Law (the Venice Commission). This advisory
body within the Council of Europe specializes in the
field of constitutional law.
The Venice Commission is composed of independent
experts from member states of the Council of Europe,
as well as from non-member states. At present, some
forty states participate in the work of the Commission.
Its main task is to co-operate with countries that
request its assistance in the process of constitutional
reforms. However, the Commission also undertakes
general studies and proposes other draft laws and
treaties.
The Venice Commission first began work in Albania
in the last three months of 1991 when the Commission
provided assistance with constitutional, media, social,
educational, and local authority reforms. Pursuant to
interest expressed by the Government of Albania, the
Commission formed a special Task Force for Albania
in October 1997. This Task Force was established
specifically to assist in the drafting of the Albanian
Constitution. The experts of the Task Force will be on
standby, available to help the Albanian constitution
drafters with analysis, commentary, and consultations.

ABA-CEELI to Host Major Workshop

At the request of Minister Imami, the
American Bar Association's Central and
East European Law Initiative (ABA CEELI)
has agreed to host three one-day workshops covering
the three branches of government--the legislative,
executive, and judiciary. The three workshops will
provide a public forum for the in-depth discussion of
many of the issues that will have been discussed
during the constitution process. Albanian and foreign
experts (European as well as American) will be invited
as speakers at the workshops to share their expertise
with participants comprised mainly of representatives
of the three branches of government. The workshops
(tentatively scheduled for February or March) will
represent the conclusion of the initial phase of the
constitution process. (The judiciary workshop will be
co-hosted by the Albanian Association of Judges.).
Among its other efforts to assist Albania in the
development and adoption of a new democratic
constitution, CEELI has recently selected a team of
experts to help draft concept papers on various
constitutional issues and provide commentary. The
issues have been identified by the Albanian
community as being of importance in the constitutional
process. The team of experts includes:

CEELI has been working with members of the
Albanian legal community since 1991 to help build
democracy and to facilitate the transition to a
democratic system. The CEELI project, funded by the
United States Agency for International Development
(USAID), offers American and Western European
legal expertise to countries that are in the process of
modifying or restructuring their laws or legal systems.
CEELI currently operates in twenty-one countries in
Central and Eastern Europe. American lawyers
volunteer their time to work as resident "CEELI
Liaisons" for one- or two-year periods in each of these
countries. CEELI's work in Albania has included:
publishing and distributing the Albanian civil code,
civil procedure code, penal code, penal procedure
code, and other much needed legal materials
throughout Albania; working with Albanian lawyers as
co-teachers to present courses on commercial law and
other topics; assisting in the formation and operation
of a free legal-aid clinic for indigent Albanian women;
assisting the Albanian Association of Judges in
initiating the publication of its scholarly journal--the
"Jurisprudenca Shqiptare;" assisting in the formation
and development of the Albanian School of
Magistrates; assisting the Albanian National Chamber
of Advocates in the drafting and publishing of a
governing statute for their organization and a code of
ethics for advocates; assisting Albanian legal scholars
in drafting a "Handbook of Women's Rights" to
inform non-professional Albanian women about their
legal rights; and assisting in the establishment and/or
development of various law-related Albanian not-for-profit associations.
CEELI often works as a partner
with the Council of Europe, GTZ and other European
and Albanian organizations also interested in
democratic reform.

DemNet Program Focuses on NGOs

At the invitation of Minister Imami and
ACCAPP, the Albania Democracy Network
Program (DemNet) will host an NGO Forum
in Tirana, Focused Discussion Groups, and a Regional
Discussion Group on the topic of Legislative Power.
Since all of the DemNet partners are public policy-oriented NGOs which
engage in research, formulation,
and advocacy of policies and laws, the forum
organized by ORT will provide its grantees and other
NGOs an opportunity to identify and discuss the
formation of a legislative structure accessible to NGOs
and the public. ORT is in the planning stages of the
NGO Forum and it will be held in mid-December or
early January in Tirana, to be followed by the Focused
Discussion Groups in February-March, and a Regional
Discussion Group in March-April 1998.
DemNet, a project funded by USAID, is designed to
strengthen the community of public policy-oriented
non-governmental organizations (NGOs) in four
priority sectors: democracy, economic growth,
environment, and the social safety net. The program
provides technical assistance, training, and grant funds
to Albanian NGOs for their civic education and public
policy activities.
Supporting NGO Participation in the Constitution
Drafting and Approval Process
Currently, the DemNet program is providing technical
assistance and grant funds to support NGO activities in
the following areas:
Public Opinion Polls and Surveys
Building upon previous research training in 1996, the
DemNet Program is currently working with 35 NGOs
in a comprehensive national research survey. The
survey is being administered at a district level and
collects important data on the economic, political, and
social factors leading to the recent crisis and possible
solutions, and it also tests public opinion and
knowledge of state-citizen relationships. In November
1997, the survey administration will be completed, and
data analysis and reporting will be finished in January
1998. NGOs will use the research results to design
civic education and service delivery projects and to
support policy recommendations for the government.
The research results will be available to anyone who is
interested.
The DemNet Program is providing on-going technical
assistance to one of its grantees, the Society for
Democratic Culture, in its design and administration of
public opinion polls concerning the constitution
drafting and approval process.
Civic Education
The DemNet Program is providing on-going technical
assistance to its grantee, the Society for Democratic
Culture, in designing and producing four to five
nationally televised programs on the constitution.
ORT will assist the Society in forming and using
working task forces to plan each debate and offer
assistance in training moderators for the debates. ORT
will also support the Society in holding subsequent
district level discussion groups to analyze the debate.
Finally, with the results of their first public opinion
poll, the Society in cooperation with the DemNet
Program will hold an NGO strategy and planning
meeting to discuss follow-up civic education and issue
formulation, drafting, and advocacy work of NGOs.
The DemNet Program will offer funding to support
follow-up NGO activities.
The DemNet Program is providing a small grant to the
Young Researchers of Social Science in Shkodra to
sponsor a series of six formal debates involving the
participation of students and professors of social
sciences (law, history, literature, and philosophy),
NGO leaders, journalists, and lawyers and sociologists.
The debates will focus on six different topics
concerning democracy and the responsibilities of
citizen and government. To reach a broader audience,
the NGOs will seek local television and print media
coverage.
Issue Identification, Discussion, Drafting,
and
Advocacy
The DemNet Program is supporting the Albanian
Helsinki Committee through grant funds, technical
assistance and training in its human rights work. The
Helsinki Committee recently held two roundtable
discussions: one on the protection of minority rights,
and another on important constitutional issues. With
DemNet funds, the Helsinki Committee also publishes
two periodicals, a bi-weekly "Faxletter" and a
quarterly "Human Rights Newsletter" which document
local human rights concerns and procedural injustices,
as well as discussing important protections under
domestic and international law.
As mentioned above, the DemNet Program will assist
the Society for Democratic Culture in designing public
opinion polls and conducting an NGO strategy and
planning meeting to discuss the results of the Society's
first public opinion poll. The NGO strategy and
planning meeting should take place in December or
January. Interested NGOs will be assisted by ORT in
drafting recommendations for the constitutional
drafting groups.

GTZ Contribution to Constitutional Reform

After the 1997 crisis, the Albanian society has
found itself confronted with two difficult
tasks:
To re-establish and legitimate political
authority; and
To socially integrate its members.
In other words, Albanian society must answer the
questions of:
How to give itself a stable, democratic
political order; and
How to channel the, in any case, inevitable
social and political conflicts.
The drafting procedure for the new Albanian
Constitution is the "occasion" for all political and
social forces in Albania to address these problems,
which will determine Albania's political and social
stability, and, last but not least, its economic prosperity
in a democratic European and international context.
One cannot expect a constitutional set-up to define a
society's "eternal" structure, for constitutions and their
application change continuously together with
economic and social conditions--even while
simultaneously trying to preserve certain "guarantees."
Constitutions do, however, define a society's "existing
-program" and open the public space in which the
process of social "fermentation" may take place.
Wishing to underline the importance of this process,
the Legal Reform Part of the German Government
(GTZ) Project on "Economic Legislation in Albania"
will support the Constitutional Reform Program of the
Albanian Government in its aim of securing broad
participation of all social actors in the restructuring of
the country's socio-political order.
Specifically, GTZ intends:
1. To assist ACCAPP in its efforts to objectify and
coordinate the drafting and public participation
process, including the assistance of the various foreign
organisations. In this regard, GTZ is financing one of
the Albanian experts at the Center as well as
co-financing some of the planned workshops and
publications. Moreover, the GTZ Office will assist the
organisation of some of those workshops through
limited administrative support.
2. To assist those entities involved in the technical
drafting process as coordinated by ACCAPP through
expertise provided by a well- known German expert,
Dr. G81nter Frankenberg, who is a Professor for
Constitutional and Public Law at the Frankfurt
University Law School. Professor Frankenberg has
been working for more than 20 years on the various
questions regarding the constitutional set-up of modern
societies, and has documented this work in various
relevant comparative publications. He is well
acquainted with the Albanian social and legal system
as he has been involved in the drafting of a new
Albanian Administrative Procedure Code during the
past 2 years.
At the request of Albanian experts in the Ministry of
Legislative Reform, Professor Frankenberg will
specifically contribute to concept papers and technical
papers prepared by ACCAPP for public distribution.
Also, he will participate in the relevant conferences
and workshops, comment on draft proposals, and, if
requested, be involved directly in the drafting process.
3. The GTZ Legal Reform Project will suggest to the
GTZ Project for the Development of Local
Broadcasting Stations in Albania to assist in the
promotion of public information and discussion
regarding the various constitutional and legal issues
involved in this process.
4. In extension and realisation of the constitutional
reform process, in coordination with other donors,
GTZ will assist with the entire process of related
institutional reforms, focusing on:
Reform of court organisation
Reform of administrative (court) procedure
Reform of local government and
administration
Reform of the civil service
Reform of the media and press

ACCAPP Assembles Initial Issue List
To provide an initial basis for planning and
discussion, ACCAPP solicited input from a
variety of professionals, both Albanian and
international, to develop a basic list of potential issues.
Copies of the issue list are available both in English
and Albanian. This issue list is not a definitive issue
list, but rather an ongoing attempt to facilitate
constitutional discussions. While many of these issues
are addressed in Albania's Interim Constitutional
Provisions, others are not. In addition, all the issues
listed therein are not necessarily constitutional in
nature. However, all these issues have arisen in the
context of the Albanian constitution drafting process.
ACCAPP welcomes all commentary on these issues,
as well as suggestions for additional issues to add to
the list.
In this regard, ACCAPP is currently seeking
contributions for "concept papers" and "technical
papers" to facilitate discussion of these issues.
Concept papers are intended to be short papers (2-5
typewritten pages) directed to the Albanian general
public. Technical papers are intended to be detailed
legal discussions of particular issues directed to the
constitutional drafters themselves. While ACCAPP
welcomes all submissions, ACCAPP cannot guarantee
the publication and/or distribution of a particular
concept paper, and ACCAPP reserves editorial
discretion as to the format and content of all materials
submitted for publication and distribution.
Though submissions on all topics are welcome, the
local legal community has expressed particular interest
in several topics. These topics are as follows:
Judicial Power and the Role of the General
Prosecutor
Selection, Appointment, and Disciplining of
Judges
Bicameral vs. Unicameral Legislature and the
Relationship of the Legislature with Local
Government and the Other Branches of
Government
System of Government: Presidential, Semi-Presidential,

ACCAPP is still searching for additional
commitments, particularly with regard to topics on the
executive and local power issues.
Suggested Concept Paper Format
Concept papers should be phrased in generic terms so
that the average citizen can focus on the universal
application of the issue and no specific political or
cultural references are present to distract or prejudice
the reader. In addition, ACCAPP requests that all
concept papers contain:
A short statement (generally one paragraph)
describing the issue and its historical and/or
international relevance to a constitution.
A brief example that describes, in non-technical
terms, how and why the
issue is of
importance to the average citizen.
A general discussion of the issue, analyzing--to
the extent
possible--the various options that
are available to address the issue and the
consequences of each.
Ministry-NDI-ACCAPP Strategic Planning
At the request of Minister Imami, the National
Democratic Institute for International Affairs
(NDI) organized a strategic planning session
at the Ministry of Legislative Reform, on 10-11
November 1997. NDI expert Lynn Hunter, a former
member of Canadian Parliament with experience in
constitutional campaigns and referendums, chaired the
strategic planning session.
The aim of this session was to assist Ministry and
ACCAPP staff with the development of a strategy for
encouraging public participation in the constitution
drafting process and coordinating communications.
After a productive two days, the Ministry and
ACCAPP developed a basic plan for fostering public
participation and coordinating communications. The
meeting closed with a plan for further meetings to
define additional details.
The NDI project in Albania is funded by USAID.
NDI is an international technical assistance provider
with broad experience in the areas of practical training
in participatory democracy, supporting professional
development of legislatures, encouraging greater
public participation in the legislative process, and
promoting the principles of transparency and
accountability in national policymaking.

ACCAPP Organizes Law School Contest
To stimulate discussion amongst students,
ACCAPP organized a contest at the
University of Tirana Faculty of Law.
ACCAPP recognizes that law students may contribute
to the process, and their involvement will play an
important role in their professional education,
preparing them to defend and explain constitutional
principles in the future.
In furtherance of this objective, ACCAPP initiated
"The Contest for the Best Concept Paper." The contest
is open to all law students past the first year. Students
will select one of the identified potential issues
concerning the constitution (discussed in the above
article) and draft a concept paper on the topic.
Deadline for the completion of finished papers is 25
November 1997.
After the deadline, the papers will be reviewed by
members of the Technical Staff and ACCAPP staff.
The best papers will receive prizes. There will be two
types of prizes. First, the best papers will be presented
to the Constitutional Commission of the Parliament
and its Technical Staff, following which they will be
included in a publication documenting the constitution
drafting process. Second, the authors of the best
papers will receive additional prizes in a small
ceremony to be scheduled later.
ACCAPP staff members distributing issue lists have
received an enthusiastic response from law students.
ACCAPP will announce the winners in the next edition
of the Constitutional Coordinator.
A Note to Donors
While donor responses have been positive,
there remains a great need for additional
assistance. ACCAPP has yet to receive
donor commitments sufficient to cover the outstanding
needs. In this regard, it should be emphasized that
ACCAPP does not possess an independent budget to
engage in substantive activities and that donor
involvement will remain an essential element
throughout the constitution drafting process. ACCAPP
staff stands ready to assist donors in developing plans
for participating in this crucial endeavour. All donors
should feel free to contact ACCAPP during office

coordination of public participation.

Administrative Center for Coordination of Assistance and Public

ACCAPP is an independent entity, formed at the request of the Government
of Albania and sponsored by the Organization for Security and Cooperation
in Europe. Its mission is to coordinate assistance and public participation
in
the drafting of a constitution for the Republic of Albania.
