Given that, the VALUES OF THE PEOPLE must be determiners of the meaning of portions of the Charter when such meaning is in doubt ... as often is the case. Moreover, the people have the power to amend any aspect of the Constitution according to their values.
In the words of Chief Judge of the Supreme Court of Canada, Beverley McLachlin "...underlying the Constitution are some basic values ...." (Western Standard, April 24/06).
McLachlin added that "THE CONSTITUTION IS FIRST AND FOREMOST AND FUNDAMENTAL".
Canada, the Charter tells us, "...is founded upon principles that recognize the supremacy of God and the rule of law ...."
Canada therefore has one political party ... The Party of God.
As Section 1 tells us, it is the PUBLIC GOOD which is paramount. If we apply a time-honoured dichotomy, the God of Canada is the Spirit of the Law and the letter or manifestation of that Law is found in expression of the way of life of Canadian citizens. What is good for Canadians? That is the Constitution of Canada.
How well can we articulate the greatest public good? What if Whistler Village became Whistler City?
