GRAND MASTER'S  LEGAL SITUATION

In the beginnings of the 90’s, Mr. Isaac Schuster Smith requested Col. $25’000.000 (US$20.000 aprox.) as a personal loan to Mr. Juan Chaljub, and gave him two personal checks, one of them was Col. $15’000.000, and other one was Col. $10’000.000, payable to Mr. Juan Chaljub’s son,  Mr. Juan A. Chaljub Jr.   Mr. Juan Chaljub (the father) dead by heart attack; and when the credit expired, Mr. Juan A. Chaljub Jr, went to the bank and try to collect the cash from the loan, but Mr. Isaac Schuster Smith’s account was closed by himself time before.

In this situation, Mr. Juan Chaljub Jr’s family demanded from Mr. Isaac Schuster Smith to pay the loan extended to him by their father; and Mr. Isaac Schuster Smith told them he did not have any money to pay the loan at those time, but he can give them a long term deposit found title, and at the end of the period Mr. Juan A. Chaljub Jr.’s family can recover the cash as loan payment.

At the end of time agreed, Mr. Juan A. Chaljub Jr., in representation of his family, went to Selfiducia S.A. local office and according with the long term deposit found title received from Mr. Isaac Schuster Smith, demanded the Col. $25’000.000 cash money.  The answer from Selfiducia S.A. staff was that money was paid to Mr. Isaac Schuster Smith days before.

In front of this, Mr. Juan A. Chaljub Jr. presented a legal demand by fraud against Mr. Isaac Schuster Smith at the Local Court.  Based on this demand, a 1st Local Court Fiscal Delegate iniciated a process Nº 13497 against Mr. Isaac Schuster Smith, and charged him by fraud, on June the 4th 1997.

In addition this penal process, Mr. Juan A. Chaljub Jr. presented a civil demand against Mr. Isaac Schuster Smith, to get the payment for the loan issued to him by his father several years ago.  According with the Colombian Law and the Colombian Penal Procedure Code, even if Mr. Isaac Schuster Smith and Mr. Juan A. Chaljub Jr.’s family get and agreement to pay the loan, the fraud criminal conduct still is investigated and punished by the Colombian Law.
