Third Eye Blind is among the many defendants named in a trademark infringement suit filed by 13th Floor, a clothing and design company, and its owners Eric J.
Ruffing and David Parmley, on Monday (Jan. 4) in United States District Court, Central District of California.
13th Floor claims that Third Eye Blind have worn clothing bearing the 13th Floor Mark and used other items such as stickers bearing the mark as well. The mark in question is the Third Eye Blind logo of the circle with the 3eb within it and another similar logo with flames at the top, which 13th Floor claims bears a substantially and confusingly similiar resemblance
to the 13th Floor Mark.
The seven-count suit also names Third Eye Blind's record label, Elektra Entertainment Group, their booking agency, Creative Artists Agency, MTV, and designers Maddocks and Company as defendants. The complaints are federal trademark infringement, federal unfair competition, California statutory unfair competition, California common law unfair competition, California
trademark dilution, copyright infringement, and accounting.
The plaintiffs are asking for a jury trial.

Owners Note: I personally think this is completely idiotic. I've never heard of 13th floor until now and I think they just want a peice of 3eb's success. I'm outraged at this accusation!
