December 10, 2002 - Update

Margie has been very depressed since the dog and pony show some called a trial found Jimmy Diesso sane.

He is in isolation at Pelican Bay become sicker and sicker.

Here is her heartbreaking update about the many ways he continues to be mistreated, mishandled and it is clear he is becoming sicker and sicker.

This is an Official U.N.I.O.N. Call to Action to end the inhumane torture of James "Jimmy Diesso, son of Margie Jump at Vacaville-C.M.F., California.

Jimmy was diagnosed as mentally ill at age 11 when he was taken from Margie by the system for truancy and taking her car out for a spin. He never came home, really, the prison system kept this boy who would hear voices, black out and call Margie lost when he was out for a month at at time.

Jimmy is now 25 years old and suffers from an organic brain disorder related to a form of Epilepsy which causes bouts of anger and loss of emotional control. His doctor Paul Remis, MD wrote to Vacaville prison in 1994 to advise them that his behavior is a treatable condition which "absolutely deserves neurological attention" and that medication may prove to be a lifesaving treatment."

Jimmy's mother has advised us that he has never been properly given his medication or appropriate medical treatment. Jimmy is frequently placed in deadly five point restraints for days at a time. Jimmy is punished for being sick by being forced to sleep on freezing cold concrete in a cell with no mattress, no blanket and no clothes on ...he is being tortured.

He is so suicidal that he recently broke up his reading glasses and swallowed them in an effort to end his life. Still, he does not receive his medication because the prison goons handle the mentally ill with violence. Of course, theis doesn't work.

Terrible things have happened to Jimmy at Vacaville. The Warden allowed another inmate to be celled wih him and now that inmate is dead. Jimmy has been brainwashed into thinking that he killed the inmate but he has no knowledge of the incident.

Prisons aren't hospitals and prison goons aren't nurses. Why is a mentally ill young man kept in the hole for years at a time, not allowed television or radio or any contact with the outside world and treated in such a manner? Why is he in a prison and not a hospital? When he is in restraints, his mother may not visit.

Jimmy is a victim of a system which has displayed so much abuse and cruelty to him for his mental illness that his condition becomes worse and worse. He is reactive to bad prison situations as a result of his illness but this is no excuse to torture him and treat him as an animal.

He is a victim of the management at Vacaville. Somehow he ended up with many ugly tatoos which he hates and it lowers his self-esteem. He doesn't know what he is doing the majority of the time, but there are also times when he is fully aware of the situation.

Please:

write a letter addressed to the Warden of Vacaville Prison, Cal Terhune, Attorney General Lockyer, the Vacaville Reporter newspaper and all of the Senaators below, Amnesty International and Governor Gray Davis, so that they will all feel the power of bombardment and know that many eyes are watching these inhumane acts. Thank you for fighting for yourself by helping other U.N.I.O.N. members. You may not realize how tightly we are all connected, but what leaves us as cause will always return to us as effects. All for one and one for all!

Inmate death sparks inquiry

California Medical Facility is under fire for what a statewide prisoners' rights group is labeling inmate abuse by a refusal to grant medical treatment.

A day after being denied medical care at a CMF clinic, Harvey Cuffs, 47, was found lying in his Unit 4 cell at 10:05 a.m. April 15, according to sources.

"We are investigating that allegation," said CMF spokeswoman Lt. Terry McDonald. "Inmates are not denied medical treatment. Inmate Cuffs was receiving on-going care."

In fact, said McDonald, he was scheduled for a medical appointment the day he died.

Cuffs was taken to the prison's emergency room where he was pronounced dead at 10:35 a.m., said McDonald. The Solano County Coroner's Office said he died of cirrhosis of the liver.

A statewide inmate rights group, UNION (United for No Injustice, Oppression or Neglect), says that Cuffs should have been given immediate treatment when he requested it the day before he died.

At 2 p.m. April 14, Cuffs entered the Unit 4 medical clinic and told a medical technical assistant that he was feeling sick and had been vomiting blood, according to Lucinda Gunn, a UNION member whose husband was in the medical clinic at the time.

Gunn's husband, an inmate, said Cuffs was given a sick call slip and told he would be treated later.

Cuffs was found by correctional officers in his cell at 10:05 a.m., said McDonald. Cuffs was lying on the cell near the door in what appeared to be blood, she said.

Cardiopulmonary resuscitation was started immediately and Cuffs was taken to the emergency room where he was pronounced dead.

UNION members said Cuffs should have been found earlier in the morning during routine cell checks. McDonald said officers checking the cells did not notice anything out of the ordinary. Cuffs was not lying on the floor during previous checks, she said.

This is not the first time UNION has targeted the Vacaville prison with claims of abuse. The group said CMF erred when it double-celled inmates James Diesso and Jeffrey Ford last year. Ford was found dead and Diesso has been charged with his murder.

UNION, which claims to have more than 4,000 members, wants Diesso moved out of Vacaville, saying he is not getting the medical care he needs. CMF officials said Diesso would not be moved.
